So reenlisted to new MOS of 25B. Failed H/W at Brigade schools and before you say that's the reason why.....hold on a sec. I never got flagged for that H/W at Brigade. Went on Christmas leave. During leave our BN Retention came back told him about what's going on about them not sending me even though I am not flagged. After leave I went to schools and asked if my date has been canceled and it wasn't and I still wasn't flagged. Went to schools so the retention NCO gets the details. He said they can defer the date and hopefully it will be accepted, I was willing to wait to go to school if need be, but will need a memo from my commander. I go back to our battery and 1sg told me to my face that the commander will bless you on going to AIT even though I was a half inch from passing. (They have sent people to school while not passing H/W here). So I go home happy and excited as I tell my wife the good news. The next morning go to schools to get the flight and so on cuz the report date was the 10th of this current month of Jan2021. My 1sgt was talking to schools. One of the schools NCO pulled me to the side and said he doesn't feel comfortable sending me because I failed the H/W at Brigade even though I am not flagged. My 1sg comes to me and says i need to talk to the CSM about you. So I wait and then she comes back to me and tells me they are going to flag me so your date will be canceled and will be stuck in this MOS and be at the Army's needs for duty station. How can they flag me without having a filled out 5500 and so on? I know the REG say that they have 3 days to counsel and turn in the flag and afterwards I have 14 days to do my part. So, can they cancel my orders for reclassification and not send me to school even though there is no paper trail within the proper days of AR600-9 to cancel my reclass orders even though I am still not Flagged?

A couple of issues here:

1. You got taped at BDE because a school was coming up. TRADOC requires a HT WT screen at every school. If you don't meet the standard to attend a school, a schools NCO has no business putting you in for a school, regardless of what a commander says.
Believe me, you're better off getting flagged now, than coming home early from school with a fail 1059 and then also getting flagged.

2. The "3 days to complete counseling and initiate a flag" is regulatory guidance, it's not a "get out of standards free" card if they don't have the paperwork done by day 3. You're an NCO, you should know better than to try to parse a reg to skate out of consequences like a barracks lawyer SPC.

3. Start working on your writing now. Writing matters in the Army, and it starts getting serious at ALC. Your post is all run on sentences.

Your first mistake was involving Schools in any way. 25B is a TDY enroute school meaning that you are on a PCS assignment right now. There are no orders to school, there are PCS orders and within those orders are instructions to attend school. So, the question is, do you have your PCS orders in hand? If so, do you have the manual 1610 for school? I'm going to guess you don't have those, which means you are not ready for school.

If you are not able to pass tape at the course you will be sent home. Since it is a TDY enroute school and you will be in the middle of a PCS, it is much better to cancel it before attending than it is to spin your family up for PCS and then return with it canceled. Especially if your follow on assignment is Korea and you have to clear before you leave.

Your command can still flag you. You were taped, they have the information necessary to fill out a 5500. When you sign a reenlistment contract you are required to remain reenlistment eligible until the benefit of the contract is realized.

Failed the Height and weight. Did you pass the tape (or whatever they do these days) or immersion test? If not or you didn't go further on the way to getting in shape then "YES" they can because you failed the H/W. If someone fails to meet the height and weight requirements, and fails the tape test, they are put on the Army Body Composition Program. They're given a maximum of six months to show “satisfactory progress” in losing weight, which the Army defines as three to eight pounds a month.
Army Directive 2012-20 covers why a commander is restricted from sending Height and Weight Failures to Army Schools.
