If an AGR (Active Guard Reserves) is Chaptered out of the Army, are they not chaptered under Active-Duty Regulations? How can a Reserve Unit chapter an Active Duty AGR under Reserve Regulations?

Only difference that I am aware of deals with the type of orders you have for your duty. If you are on Title 10 orders, you are subject to AR635-200, just like the rest of the Army. If you are on Title 32, you would fall under AR135-178. All that really amounts to is that it changes the number on the Chapter.

SFC Larry Triplett - The point I am trying to make is that I don't think JAG is going to help you much if your only claim is that they used the wrong AR. He will just make them correct it to the proper one and your still chaptered. If you are contesting that the reason for the chapter is wrong, you may have a chance. Chapter separations are Administrative functions and not a Legal Function.

0
AGRs for USAR are separated from AGR active service IAW AR 635-200, if the Soldier is to be retained as a TPU.
But chaptering out of the USAR is still IAW AR 135-178.
