I am trying to help my son, he was discharged last year form the Marine Corps, he had two minor Article 15's the first one was his SGT told him not to talk to a female he was dating, 3 days later he was accused or talking to her and given the Article 15, he accepted it and never fought it. Later he was told by JAG, that he should never have accepted it and the JAG Officer who reviewed it should never have let it go through because Command is supposed to put a no contact order in writing to be enforceable and his command never did the paperwork before or after the Article 15.
The second one was for getting food at the PX while on restriction for the first Article 15.
He received a General Discharge w/Honorable Conditions. But an RE Code of 4 - Pattern of Misconduct.
He wants to join the National Guard, he was told they could get a waiver but with "Pattern of Misconduct" as the narrative, they require a 2 year waiting period from his discharge date before applying for a waiver.
We have decided to apply for DD214 Correction asking for a more favorable code. According to several people I have spoken with including someone at the Marine Corp Recruiting Command, an RE-4 would be unusual with his circumstances and they all felt he should have received a more favorable RE-Code.
Specifically I was told an RE-4 would normally be given in his situation, if either drugs or alcohol were involved or trouble with civilian or military police officials.
In his case neither drugs or alcohol or contact with police officials were not involved.
I believe technically they can give him an RE-4 for 2 or more NJP's but again I was told this is not normal for his circumstances, which I was told should be the argument to the board as part of his application.
Any feedback, or tips on how to proceed would be greatly appreciated, he really wants to go into the National Guard, he is 20 years old and had no other issues, he completed all of his training successfully, the incidents happened at his first duty station, and there was some personal issues between him and his Sergeant that lead to this, which were unfair to him.
