Hello RallyPoint, I have a question for anyone in or knowledgeable with JAG:


I am just curious as to what kind of legal leeway soldiers have in terms of pursuing Bivens actions, if there is a case of where certain decisions and activities regarding a soldier could both warrant and be remedied by Bivens actions.

I know the Feres Doctrine has put an nearly airtight lock on any servicemembers from ever pursuing Bivens actions for any and all activities made during the course of duty (hence why LODs exist), but are there circumstances that occur outside of this doctrine which could be held accountable using Bivens actions? Please let me know.
