Can a Drill sergeant search you and only you without permission?

I’m here at AIT and I have this drill sergeant that absolutely hates everything me and another person in our platoon does the first 2 weeks we did get off on the wrong hand but I just wasn’t use to the freedom coming fresh out of basic I told her that and I’ve been staying under the radar for a while but she just looks for any and everything to chow us out about or give us a counseling so today we had a random room expectation and our rooms got trashed me and the guy she hates also so what she did was thrower everything out our drawers and brought the females to our room and told them that this is how we live and we’re dirty so she took our phones and a couple more guys I gave her a phone but she said I had more than one phone so she made me open my locker and searched through my bags in my locked locker with no permission and found a old phone I was wrong for not turning it in but everyone is telling me to go talk to my 1Sgt because it wasn’t right how I was the only one that got searched and she was never given permission to search any of my personal belongings she just decided to and made me open my locker should I talk to my first sergeant about this? Or is this just something I should just deal with 8 more weeks because I think she is trying to get me put out and I can’t take it

So your in AIT, just out of basic and you think a veteran sergeant is treating you unfairly because you violated policy with not just one but two phones? Give me a break. Your barracks room is inspectable at any time. Since you presented a phone, and are, as you stated, prone to judgement errors, she decided to look further and caught your second phone? Your LUCKY. I would have taken you to the First Sergeant and had you handed an Article 15 and possibly chaptered out of the service. If you can't handle the "Freedom" an adult has. Perhaps you should ask for the chapter yourself.

As a drill sergeant I will say yes we can do that. I don’t much think your drill sergeant would want to go against anything 350-6 says. If you can’t handle being fucked with, then I don’t think you’ll enjoy the real army. This is just the beginning private. If you feel there is an EO complaint follow the proper channels and use them.

First, You gave up your civilian constitutional rights the minute you signed your enlistment contract. You are now governed by the UCMJ. Personally, I would keep my mouth shut and learn what military discipline is for. It's not to get "back" at you, it's not to pick on you, it's not to protect you from harsh superiors. While admittedly, there are sometimes A-holes in command, by your own post, you were in the wrong. Own up to it, quit wining.
Now here's the lesson: Military discipline is to ensure that every soldier, sailor, airman and Marine are part of the team. There are really, only two, top tier reasons for this: For the team to win the battle is number one, to protect the lives of your teammates is number two. If you're not playing with the team, you are a danger to others. Learn the rules, know the rules and obey the rules. Be a proud United States Soldier. Or don't. Your choice, but its pretty simple.

A Drill Sergeant does not need permission/search warrant to search your belonging. As a Soldier in training, you belong to the Drill Sergeant and if he/she has any suspicion that something is not right, he/she can do as he/she pleases "as long as it's not unethical, immoral or illegal". As a prior Drill Sergeant, I've searched quite a few Soldiers wall locker on a one on one basis, because there was something suspicious about them. It always turned out that my Drill Sergeant sense was on point. You have to understand that we all were at one point a trainee and the majority of us did the same things that you all are doing right now, thinking that we won't know or find out about it.

Sounds like you been trouble from day one .an not doing any better saying flying under radar an still having object u know u r not authorized to have .instead of worrying about who to tell you was found doing something wrong.try working on being better Soldier.an if you go to first sergeant be sure to be ready to tell him why you had the 2nd phone.

I think you better get yourself squared away, and get back under the radar. If you don't its going to be a very rough 8 weeks that you might not make it to the end of, and permanent duty can have its problems too.

Have you tried talking with her? If not, that'd be the proper 1st step, and if that achieves nothing then go up the chain, but no, don't just tolerate that kind of invasion. If she's being entirely hostile toward you all the time, perhaps take a witness along.

LT Smith. This private is not being treated unfairly. Look at what he admits to doing. Not only did he have one phone against policy, but TWO. You think this is an invasion of his privacy. The barracks are owned by the government, there are regulations - the glue that hold units together in tough times, that everyone is expected to adhere. If this individual is left to believe that checking for contraband is illegal or unjustified, there is no telling what could happen. As far as witnesses, the drill sergeant brought witness with her so I think you need to support the NCO here for doing her job. Not coddle to the whining private who is in the wrong.

From what I have read, a lot of 1Sgt’s have responded to you. If I were you, I would take all of it onboard and heed. You are in training right now. The easy part. Once you get into the Real Army, a whole new world where you are responsible for your actions and deeds. Don’t screw up and buy the Big Chicken Dinner. It will ruining your life. Time for you to soldier up.....
