Cooperate with the investigation and follow up on your packet. If you have something to hide, seek legal as an investigation hold will really delay a retirement.

The reason I ask is I have received little or no contact from my unit regarding my retirement packet, I sent a request to state directly and they sent me everything I needed, completed all the forms and submitted them to the unit as instructed - over a month ago, then get a notice that the commander is holding the packet and requiring me to complete a DA 2823 sworn statement for somebody else who lost individual OCIE over 18 months ago but still signed their individual record less than 2 weeks ago.

Not only can they hold or delay a retirement, they can recommend denial of the request to retire. Once you hit that INDEF portion of your career, you have to ask the Army permission to leave. If you are actively involved in an investigation, your packet can be denied or delayed until the conclusion of that investigation, especially if you stand to be financially responsible. For example, if your soldier lost something...say as a result of theft...and you knew that thefts were occurring but failed to inform your subordinate...you could be held financially liable for a portion of the depreciated value of the stolen item because you are partially to blame for the soldier not taking extra steps to secure their OCIE. This isn't a made up scenario, it is one a good buddy of mine is actually going through right now. It may not be a perfect fit for your case, but it gives you an idea of what the Army can, and does, delay a retirement for.
