Stud, there is not enough info here to even start answering. Did the SM have a parenting plan as required? Why did the CoC have to step in? Do you think it is fair to have a readiness formation and allow someone to beg off because of babysitter troubles?

No, but they can "force" you to have a family care plan with an available care taker for your child 24 hours a day 7 days a week, and for as long as they have duties for you to perform.. If you refuse or can not provide that care taker you will be seperated from the service (and should be)

Child care is a service members responsibility and there is no exception for lacking it. Most commanders are reasonable folks and will work with an SM in a bind, in times of hardship or transition, but the reality is they have a duty to perform for the service they contracted with and the regulations for requiring a family care plan are known, clear and available to review at anytime.

SM should Talk with the commander and 1SG, ask for help, seek assistance from Army support agencies on post....in the end if none of that works out, they leave the unit with little choice.. Separation procedures should be initiated, and its a fairly fast chapter to get completed.. As there are no appeals, exceptions to policy, medical determinations needed, counseling required....
Family care Plain.. YES / NO, if no, SM will have 30 days, which can be extended another 30 days

SFC Kelly Fuerhoff - Hmm, not sure that makes sense either as it is self serving for the unit to expedite this easy uncontested separation.
There is no down side to a unit processing this separation as quickly as possible. I suppose, there could be an approver of the separation out of the net on TDY, and the acting CDR\, XO, what ever either does not want to sign or feels they do not have the authority to..

But I'm not coming up with a single reason CORPS to Company CDR would not want this to go as fast as possible????? It only benefits them ..and any delay hurts the unit

All kinds of weird here. I can't see any CoC allowing a child at work in the MP...etc. I have seen CDR's and 1SGs take things a little personal. Once the wife expressed the desire for a chapter, I can them not wanting to be manipulated. I don't recall but is there separation pay for this Chapter? Why not just ETS. With his Green to Gold, they've got some managing to do. Good luck to them.

of course not but if don't have a VIABLE Family care plan, you can be put out and should be put out.

it sounds like they're opting to be put out, but the unit isn't acting quickly enough for it.
