Short answer...yes; currently. HRC/DA is working to update their policy.

The intent should be when the QMP Boards recommends retention and it goes to DA, G-1 for approval, the IMPEPR Code is changed from 9W to the previous IMREPR Code (Normally a 10 or Blank)

SGM disregard. First off thank you for your help with this situation, but i finally got the answer to my question (offically). Took some time but at least NOW i know where i stand and im not wondering anymore

SGM do you have any idea when that policy is expected to be updated? Sadly I have had 2 battalion CoC support me to keep me in and want me to reelinst, sadly BDE has a different opinion. I know this was an OLD message dated back to like 2012, but I have tried every avenue of approach I can think of with NO success on any front

So what was the outcome ? Is it up to your BDE CO to remove the 9W code ? I'm in the same situation and my retention knows zero !!SSG (Join to see) -

From everything I got from them MILPER message ...anyone with an NO on your army values blocks or has a 4 or lower on their ncoer will automatically be given that code but they get it from HRC no one else can remove it but then your brigade can only sign a reenlistment waiver for you so you can still reenlist with the code on there unfortunately you have about a 99.99% chance of never actually seeing Sergeant First Class because of that code so you're going to have to fight the NCOER and see if you can get whatever caused the 9W in this first place removed

Im looking and do not see the two differing lines of administrative action limiting or affecting one or another in this way.
Specifically 9W | Not Eligible Due to SSG NCOER/NCOES Eligibility Requirements; In other words, an alleged failure to meet Staff Sergeant (SSG) E-6 rank requirements. IAW AR 600–8–19
the 2016 QMP directive make no mention I can find that would address a limitation of the RE code 9w being given

SSG (Join to see) - I do not find that the QMP procedures reference limit, allow for or mention RE codes.. Meaning I see no reason the 9W can not be given as an RE code regardless of a QMP action.
Looking at QMP directives and regulations I do not see it mentioned that a RE code of XX must be given or is restricted from being set based on QMP selection or not..

What I can not see is MILPER messages, or other directives that may speak to this issue. either looking forward as guidence or in responding to a question from the field.
So I can not say definitely either way, just that it's not a slam dunk supported action or restricted action in the regulations and directives I have access to.

thank you very much for the information and help clear a few things up and it something I can take with me when I go to legal and bring up the discussion with the lawyer again I really do appreciate all your assistance with this regardless of the outcome thank you again
