Can somebody please give clarification on AR 600-8-24?

My UQR packet has been returned from HRC without action. The reason submission is too early. These references were given from AR 600-8-24:
Chapter 2
Release from Active Duty of Reserve Component Commissioned and Warrant Officers
2–5. Voluntary release from active duty due to personal reasons
a. If eligible under the criteria prescribed in paragraph 2–5b, an officer may request REFRAD whenever such action is considered appropriate (see fig 2–1). Unless otherwise specified, application for REFRAD will be submitted not earlier than 12 months or no later than 6 months before the desired release date or beginning date of transition leave, whichever is the earliest.
Chapter 3
Resignations
3–1.
c. Under normal circumstances, any RA officer or USAR officer who has completed their 8-year MSO may submit a request for unqualified resignation, provided all Service remaining requirements have been met. Such application will be submitted not earlier than 12 months or less than 6 months prior to the requested separation date. The 6-month requirement may be waived by the SAA, except in the case of an officer who has not fulfilled the 8-year MSO, or is requesting a Reserve commission concurrent with REFRAD. Appropriate documentation must accompany the request.
The email also said since I am AD I can't submit my packet 12 month prior from my terminal leave start date. I know another pilot who submitted his packet last year and he had no issues, he is in the same situation. A quick research on google brought me to an article of a pilot who went through this process back in 2018, his article mentioned that you can submit UQR packet 12 month prior from your terminal leave start date. Can somebody please clarify this regulation please?

The regulation reads confusing. You can't submit prior to 12 months from your separation date. In your UQR memo you request an ETS date, that's the 12 month mark you work off of. It's the same for retirement as well.

Without physically seeing your packet I would guess it's one of three things: You have the wrong date on your memo, you still have an SRR for something, or your packet didn't make it to HRC and was returned by an intermediate authority who misread/misunderstood the regulation or your request.

I don't have any SRR's left. I have checked my dates hundreds of times and as I mentioned in original post another person just recently went through the same process and had no issues. I used his packet as a reference. He submitted his packet 12 month prior his terminal leave start date. I talked to the person in charge of MPD and she definitely submitted my packet(according to her). The paragraph I was given as a reference is: 2–5. Voluntary release from active duty due to personal reasons which I don't fall under. Paragraph 2–6. Voluntary release from active duty due to expiration of active duty commitment is the correct one. This makes me think the person who processed my packet at HRC is brand new and doesn't have much experience(I have experienced this one in military a lot). The regulation is hard to interpret the paragraph 3-1 is contradicting with some paragraphs in Chapter 2. Thank you for your response though. I will stop by MPD next week again.
P.S. HRC also mentioned in the email that terminal leave rule applies to Reserve component only since chapter 2 is named Release from Active Duty of Reserve Component Commissioned and Warrant Officers.

CW2 (Join to see) in my experience no two people situation are ever exactly the same, and so it's misleading to use your situation to compare yourself to them. Also, in my experience HRC is usually staffed by experienced people, except for when they switch branch managers around
When I prepared UQR memos for officers the guidance was 12 months from ETS not terminal leave. I didn't question that but it came from the Silver Siege Recruiter and the crusty old Transitions guy at MPD. You could try contacting your post Silver Siege for more guidance. You're required to go through them as part of your clearing process anyway
Being slightly more awake I realize that chapter 2 is for Reservists. You should fall under Chapter 3-1c; normal Resignation

May have changed, but AFAIK, if you are a Reserve Officer on AD at the end of 2 years, if you not have a longer commitment for some special schooling or recovering from LOD injuries that requires a longer period, one is REFRAD automagically almost.

Read This Next
