My husband got out of the Army in 2018 and is about to re enlist, we are currently separated, I just arrived back from overseas and had to sign a lease at my new duty station due to the fact that I am currently married with a dependent soon to be dual military. I am trying to find the regulations on how I could get out of my lease or if I was able to keep my BAH until my lease ends or if I will be able to retain my BAH while filing due to us now being DUAL Mil again. I have only been able to get vague answers about needing an ETP to retain BAH until my lease is up/ divorce is finalized.

Sounds like the answer was straightforward. You file an ETP to cover your lease. The post commander is the approval authority for your certificate of non availability. Get with your housing office

No, the dependent rate will end the date your divorce is official...unless you have children
