Considering all the illegal immigrants in this country, do you think they should be able to use welfare or public assistance considering they aren't citizens and that many working Americans are denied welfare or public assistance.

Rewarding criminal behavior. This is a great idea. What harm could it cause? You want to come to the US, there is a right way to do it. Public officials are afraid to take a firm stand on illegal immigration because they want to keep their jobs.

This is a very easy question to answer. It is against the law for illegal immigrants to receive public assistance. That is exactly why our forefathers made it illegal in 1914, they knew the public would not be able to support everyone in the world that came here because we are such a generous people. ALL illegals should be sent back and the anchor baby laws repealed. Anyone that cannot prove someone in their direct line came to America LEGALLY or was an American citizen in the last 100 years should have US citizenship revoked and sent back to the country their parents came from.

The key phrase is they are here ILLEGALLY. As far as that goes, the Constitution is meant to apply to U.S. Citizens (and green card holders (IE people legally allowed into the U.S.) and does not apply to illegal immigrants. Therefore they should have no right to sue anyone in the United States, they are not entitled to our medical or welfare programs and they should not be allowed due process for anything in America.

Being in this country illegally should be a CAPITAL offense. Change the law, give them 120 days to wrap up their affairs and get out. Most will self deport at no cost to the American taxpayers, and this will alleviate many of the welfare, medical and education system problems in the United States.
At the end of 120 days, start rounding them up and have public hangings / executions and the rest will self-deport.
They can be welcomed back when they come back LEGALLY through a vetting process.

SGT (Join to see) - I'm with you WTF. SFC Holloway's ideas are very offensive, not practical, certainly not in line with the US constitution. But his sentiment is expressed by millions of Americans. The liberals created this atmosphere by fighting everything. They create it by never coming to the table to have real discussions. Its their way or no way. That is not going to work. Civil war will come if the liberals don't wise up and stop the "everything the conservatives do is bad" mentality. The right is not innocent either, don't get me wrong. But their not as bad as the left.

The fact is that there are three kinds of people.
1. People that obey laws because it is the right thing to do.(unfortunately the minority these days)
2. People that simply don't obey laws because they don't care (hardened criminals).
3. People that obey laws because they are afraid of the consequences. (which encompasses most people)

There are currently around 25 - 30 million illegal aliens currently in our country. (I worked to DHS in Border Patrol Intelligence and they would not allow actual estimates to be published.) Obviously none of them belong to group one. The people in group two are hardened criminals and will continue to break ours and other countries law, no matter what. So that leaves the people in group three.
Obviously, the consequences for breaking the law are not strict enough.
Have you ever had a speeding ticket. Most of us have. Why did you get it? You could come up with something like: I was late for an appointment, etc.... but that is crap.
The real reason you got the ticket is that you consciously or sub-consciously weighed the probability of getting caught VS the punishment (fine) if you did get caught and determined that it was worth the risk. Now let's say the punishment for speeding was a capital offense. Would you be so ready to speed? I would say probably not. My guess is that you would hardly ever see someone caught speeding.
It is time for REAL consequences for illegal immigration. Prison or any other penalty would cost American taxpayers HUGE amounts of money. Why should we, the American people pay to incarcerate citizens from other countries that illegally entered America anyway. Give them 120 to 190 days of fair warning TO GET OUT.
What is "practical"? Continuing to allow illegal immigrants to commit crimes on American citizens? Continue to allow them to take American jobs when Americans are out of work? Continue to tax our welfare, medical and education systems? Allow them to illegally vote in our elections?
I don't think so. Americans should not be punished for the illegal immigrants that blatantly violate our laws and should not be here in the first place.
As far as Constitutionality, I will note that ILLEGAL IMMIGRANTS SHOULD NOT HAVE ANY RIGHTS UNDER THE CONSTITUTION as the Constitution was written for American citizens and defines what an American citizen is within it. It DOES NOT cover citizens of other countries.

Texas Senator Dan Patrick stated: "“We charged them with 447,000 crimes, a half-million crimes in four years, just in Texas, including over 5,000 rapes and 2,000 murders,” Patrick said. “from 2008 to 2012, 143,000 illegal immigrant criminals were arrested and jailed in Texas. He said these were “hardened criminals, gang members, and other criminals that we identified as being in Texas illegally.” We estimate we have 100,000 gang members here illegally.”

However, I am assuming that you are talking about "anchor babies" that are currently in America, so let's address this:
The Constitution is referred to as "the law of the land. Our founding documents and states in it in the 6th Amendment that the Constitution is the "supreme law of the land". It provides that state courts are bound by the supreme law; in case of conflict between federal and state law, the federal law must be applied.

Now, with reference to immigration:
The 14th amendment says "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside."
Anchor babies are a violation of the 14th Amendment of the Constitution and it's intent because of a gross misinterpretation of the 14th Amendment.

How do we know this? We know this because Senator Jacob Howard was on the Senate Joint Committee on Reconstruction, which drafted the Fourteenth Amendment to the United States Constitution. In 1866, Senator Jacob Howard clearly spelled out the intent of the 14th Amendment by writing:
"Every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country."
The phrase "subject to the jurisdiction thereof" was intended to exclude American-born persons from automatic citizenship whose allegiance to the United States was not complete. With illegal aliens who are unlawfully in the United States, their native country has a claim of allegiance on the child. Thus, the completeness of their allegiance to the United States is impaired, which therefore precludes automatic citizenship.
The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby.

Therefore, anchor babies ARE NOT legal citizens of the United States. You will also note that Texas no longer issues birth certificates for "anchor babies" because it is against the constitution.
Example: I have one child that was born in another country. Was he a citizen of that country? NO!!! I had to go to the American Consulate and get an American Citizen "Report of Birth Abroad" which serves as his birth certificate.

As far as these "children". Anyone that is a product of the "Anchor baby" program and cannot prove that they were born of at least one existing American citizen should be sent back to whatever country they, or their parents / grandparents originated from. They should not be America's problem. We have enough of our own, with illegal immigration being a BIG one.

That has to be one of the stupidest remarks I've seen. Every country has crime, but the fact is, if illegal aliens weren't in the country they couldn't commit crimes on American citizens.

We have enough home-grown criminals without importing them from other countries.

The hardest part for some people to understand is that if we allow illegal immigrants into our country then what is the point of immigration or immigration laws. When you break the law there are consequences otherwise what is the point of enforcing them. Immigration laws are in set to keep our country safe and from being over populated. There are thousands of people that immigrate legally everyday in the United States. What makes anyone more or less above the law to immigrate illegally in our country? The answer is simple no one is.

My father immigrated to this country 2 years before the family came, he sponsored the family as a 13 year old it was very hard with two other brothers, at 18 joined the Navy and retired 20 years later, all I can say come legally follow our laws or don't come at all

In order to qualify for this benefit program, you must be a resident of the state of California, a U.S. national, citizen, permanent resident, or legal alien, in need of health care/insurance assistance, whose financial situation would be characterized as low income or very low income. You must also be either pregnant, blind, have a disability or a family member in your household with a disability, be responsible for children under 19 years of age, or be 65 years of age or older. Illegal Alien is the correct verbiage No such thing as Undocumented Immigrant . Just a term used by the last administration and its PC minions The same with other terms such as Overseas Contingency for military action and Workplace Violence for known terrorism.

You're right... they should not be offered assistance of ANY kind, food, welfare, education, medical, and certainly no help getting documented. They can go back to their country and apply for citizenship like legal immigrants have done.

****They Drain The System****
Undocumented immigrants do not qualify for welfare, food stamps, Medicaid, and most other public benefits. Most of these programs require proof of legal immigration status and under the 1996 welfare law, even LEGAL immigrants cannot receive these benefits until they have been in the United States for more than five years.

****They Don't Pay Taxes****
Undocumented immigrants are already U.S. taxpayers. Collectively, they paid an estimated $10.6 billion to state and local taxes in 2010, according to the Institute on Taxation and Economic Policy (ITEP), a research organization that works on tax policy issues. Contributions varied by state. In Montana they contributed $2 million. In California, more than $2.2 billion. On average they pay about 6.4% of their income in state and local taxes, ITEP said.

****They don't pay into Social Security****
The truth is that undocumented immigrants contribute more in payroll taxes than they will ever consume in public benefits. Take Social Security. According to the Social Security Administration (SSA), unauthorized immigrants -- who are not eligible to receive Social Security benefits -- have paid an eye-popping $100 billion into the fund over the past decade.
"They are paying an estimated $15 billion a year into Social Security with no intention of ever collecting benefits," Stephen Goss, chief actuary of the SSA told CNNMoney. "Without the estimated 3.1 million undocumented immigrants paying into the system, Social Security would have entered persistent shortfall of tax revenue to cover payouts starting in 2009," he said.
As the baby boom generation ages and retires, immigrant workers are key to shoring up Social Security and counteracting the effects of the decline in U.S.-born workers paying into the system, Goss said. Without immigrants, the Social Security Board of Trustees projects that the system will no longer be able to pay the full promised benefits by 2037.

****They take American jobs****
The American economy needs immigrant workers. The belief that immigrants take jobs that can otherwise be filled by hard-working Americans has been disputed by an overwhelming number of economic research studies and data. Removing millions of undocumented workers from the economy would also remove millions of entrepreneurs, consumers and taxpayers. The economy would actually lose jobs. Second, native-born workers and immigrant workers tend to possess different skills that often complement one another.

SGT(P) Gloria Francis - You are correct, "Mexicans" are not the only illegal group. However they are the largest. Additionally, for the sake of keeping my example under 30000 words, I stuck to just two examples (Mex and Chinese). I have a Mexican mom so I can assure you I have no "fear". I'm in the ER now with my daughter. No SSN. Perhaps thats something your area does on its own? I've never been asked for it. Only for my insurance card.

SSN's are used fraudulently which we know of. This is why investigation is key. Your I-9 form is supposed to be investigated. Problem is, that takes time. Not too much (I used to do it) but when little is done to enforce it, like fraudulent voting, then its easy to see how it gets abused. Also, like I said in another example, a lot of areas are SSN free due to circumstances. No Child Left Behind is able to jump fences. The school itself jumps fences. If children sit down in the cafeteria they will be given free breakfast with no questions asked. If children look "tatty" there are donation clothes for them as "assistance agencies" don't want children to be bullied or self-esteem affected.

And if your school is in a low-income area (like ours is) then the lunch will pretty much be free as well with no questions asked. Now I'm not going to get in to a thesis on why that should and shouldn't happen because thats another argument in itself. My only angle is that the SSN is only one component in illegal employment. The **FACT** that someone is hiring them to begin with is your main component. As I've said time and time again, they come because they are hired. Were there to be no jobs, they'd leave.

As to the Mexicans themselves, I think we both know that Pennsylvania Avenue would be the cause of your publicity problem. I too find it interesting, that certain parties dwell on Mexicans and Mexicans only. And that wouldn't be an angle to get votes, would it?

Sgt (Verify To See) - Both don't pay taxes, the one who hired them doesn't pay payroll taxes nor does the employee. So who is taken advantage of who? Most Mexicans, Central Americans, etc.. that come here barely have an elementary education as opposed to the employer that hires them, who more than likely is a high school graduate and knows the tax system better than the so called " legal scholars " that come over seeking work.

Instead of making a rash judgement. I'd have to easily and quickly check if they would be more of an asset to our socio-economic system rather than a burden. That would mean a health check-up, a test of their skills and education, as well as a test on their determination to succeed and appreciation of what they can gain here through hard work.

Thats condoning crime. "You're illegal but as you work hard, I'll reward you." Doesn't work that way. Get in line - like my wife did - and wait your turn to be accepted in to the country and given a green card. My city deported a family two years ago for the same thing. "Hard workers" "kids polite and graduated from high school," "paid taxes." Yet...illegal.
