Curious as to whether an active duty officer keeps their promotable status when transitioning to ARNG. I'm leaving AD approximately three months before I'm due to promote from 1LT to CPT. I'm immediately transitioning to WVARNG in my basic branch (MI) while my JAG packet is pending. For clarification, I practiced law before I joined the military, so there will be no educational delays assuming my JAG packet is accepted.

I've tried looking for the appropriate regulation, but I can't seem to find anything that is relevant. Any help would be much appreciated.

1LT (Join to see) The short answer is, "yes." However, promotions work very differently in the ARNG. You will need to be in an O-3 slot to be promoted.

Before transitioning out to the Guard, see what unit gives you the best deal. Never take a slot that is for your current rank unless other factors are more important. Take one that will promote you when take over the slot of shortly afterwards. Also beware of orphan jobs. Those are ones where you can only reach a certain rank within the unit in your field & then to get promoted, you have to move to a different unit. Certain specialties have that issue in the Guard. Getting slotted for one rank above is easy but if the next rank in your field is 2 ranks above, you usually have to go to another unit to move up.
