How long before you can get a TS clearance as a MAVNI?

Military Accessions Vital to the National Interest (MAVNI). Reclassing to another MOS that requires TS and I am hearing I have to wait until my 2 years mark

Peter Levine, the Acting Undersecretary of Defense for Personnel and Readiness, issued a new memo in September 2016 that says that MAVNIs cannot get any sort of security clearance (not even an interim one), until they have completed their first term of service. This means that henceforth, no MAVNI can be an officer or serve as a military linguist or otherwise hold a job that requires a security clearance, until the MAVNI has completed his or her first term of service. The order is probably unconstitutional (MAVNIs seeking security clearances are US citizens, and the same rule does not apply to green card holders or other noncitizen enlistees who have naturalized through military service) but it will take awhile before a lawsuit makes its way through the courts.

Would an existing security clearance be rescinded due to the above memo due to a soldier having enlisted through the MAVNI program 3 years ago? A security clearance was originally granted as a result of the required SSBI investigation. Soldier is currently applying for OCS and has renounced her dual citizenship and has turned in her foreign passports in for destruction at the insistence of the post Security Manager and the DoD CAF. (They even demanded destruction of her old expired passports used as a child.)

They are probably saying 2 years to account for your time in MAVNI. And getting a TS as a Natural born citizen straight out of high school with the basic information for the SF86 is said to be taking upwards of 18 months for the investigation. If you plan to make the Army a career then hang in there. Just remember the Army has the whole Hurry up and Wait mentality. Hope this helps you understand the whole two year time-frame.

Right. But I am already Top secret Favorable per JPAS having been through the whole SSBI process. I believe at this point it should by a matter of a justification as to why you need the TSC.

I've never heard of a time in service requirement for a security clearance. Once you are transferred to your new position, and assuming you are in a position that requires a TS, work with your S-2 shop to begin to initiate your security clearance process. Once it starts processing, it can take a few months to over a year to complete the processing depending on your background and situation.

My SSBI is already done and I'm favorable for TS. I have applied and got accepted into the 17C mos and one of the requirements before you start school is to have TS. I guess my S2 haven't really dealt my MAVNI and I was in contact with this NCO at G2 but he ETS'ed and It became hard to get in contact with them that is why I'm here

If you are in an MOS that requires a TS, you can get one. But most MAVNIs are not in an MOS that requires a TS, because all MAVNIs are noncitizens when they join the military. Noncitizens aren't allowed to enlist into an MOS that requires a TS. If you are a MAVNI, you enlisted into an MOS that did not require a security clearance. Once you are a US citizen, if you reclassify into an MOS that requires a TS, you can get one. Your command will have to initiate the request for your TS.

Ma'am, if you're MAVNI in a MOS that doesn't require secret and you want to re-class to a MOS that require SC, does your losing command initiate the SC or the gaining command. I'm asking because I tried to drop my packet for an MOS that require SC and they didn't even look at my packet because I "do not qualify" because of the SC.

Thanks . I am already TS favorable having done the SSBI before joining per my S2. I took me like 3 days to get my secret through G2 but I don't currently have the same resources

No I am still waiting on that almost a year after. Now I am told that I have to do my SSBI over because I am upgrading from secret to Top Secret. I have been doing my research but I don't see anywhere that stated that. I was already Top secret favorable on my JPAS. Don't even know what to do at this point

LOL MAVNI!!!!! you are in good luck!!!!! I am an expert on that ... I have been trying to go into service through MAVNI for a long time ... since the beginning of the program.But ... things just don't work out ... it take so long ... I already got my PR and join the service in a different route. Fate is funny ... if I gone through MAVNI ... I would properly in Army now. But I guess I belong to the SEA!!!
Anyway, as a MAVNI, you are not eligible to TS when you are in the MAVNI program. After you are a citizen, you can get TS just like anyone who qualified for it. You can go through the TS background check immediately right after your citizenship swearing.To get it ... that will depend on your background ...

The MOS is not a TS job. Unless the unit is requiring it. Which doesn't make sense. You knew the mos wasn't a TS when you joined at MEPS. Am I missing something?

No SFC I logged in through Facebook so It kept that name. I went to my S2 but they didn't give me a clear answer. I'm SPC Houedan I should probably change my name to that

There is no clear answer for that. Your S2 will not begin processing you until you have a need. A memorandum from command or retention normaly gets this ball rolling. Once the processing is done at unit level the most they can do is issue an interim, but in your situation probably isn't needed. After that it's in the hands of ACCF, who appoints an investigation team through FIS. Based on their schedule, they will conduct several interviews with family, friends, commanders, NCO,s and other people you've had regular contact with. They will contact people not even listed on your SF81. They will interview you. Than I have seen it go as quick as 6 months. Generally it takes a lot longer.

Your new MOSQC will have the investigation run while you are in the course. You'll have appointments to meet with investigators and whatnot throughout the course.

I am processing my MAVNI application and I also have interest in 17C. Did you get your TSC worked out?

As a MAVNI, you cannot apply for 17C MOS, its on the MILPER message 17-058. Thats why im trying on 25D.

You can't get a ts clearance as a foreign national. Once your citizenship goes through, it's a whole different story. If you've already become a citizen then the normal clearance procedures apply. In which case a few months to a few years depending on your personal situation.
