How long is too long for a drug test to come back and bite a Soldier? Is there a statute of limitations?

I was a JAG for over 5 years and an officer for over 13. The UCMJ has a statute of limitations of 5 years for a court martial and 2 years for an Article 15 for all offenses except those offenses that are more egregious (i.e. murder, rape, etc.)

I did my time in the Army and now retired. If you want to smoke dope then get out. The rules are in place to protect the soldier to your left and right. My pcm had me on addictive pain meds and yes I got hooked on them. I was lucky enough to get help. Most young soldiers who pop hot get a second chance. If you make the mistake and smoke as a NCO then there is no second chance. The simple choice is not touch the stuff.

LCpl Adam Krum - what is it about contraband and illegal you don't understand? Every service informs you up front before you enlist, again during boot camp and continously at least on an annualy basis of the consequences if you do drugs. You also swore an oath to obey the UCMJ. So either you're just freaking retarded or your oath means nothing and you are not to be trusted. You deserve every consequence you earn due to your actions. If that means an OTH or BCD then you earned that Shipmate. Life's a bitch.

I served and sometimes its not always about a solider isn't strong enough or weak minded or not disciplined, sometimes a soldier has been threw things and the people you suppose to turn to aren't any help(E-5 or Higher). I was deployed as soon as I came out of AIT and was blown up twice the 2nd week over in Afghanistan, as a result I wasn't sleeping for days at a time, which is bad for my battles rite? Me being on the field after been up 4 or 5 days, but to you higher ranking thats dedication huh, wait that's a real soldier huh? Lol, every soldier isn't bad, maybe if those people were given the help that they told they would receive some wouldn't use drugs. On the other hand you have soldiers who just are cut for the military and they can only adapt for so long till they old ways catch up with them, a lot of soldiers (people) deal with stress and everything different. Bet half the people that post on here drink them selves silly but that's not a problem huh. Statically speaking alcohol does more harm to your body and brain then marijuana. hypocrites cause you u been in for so long, wow!!!. The person that got the boot out the military still should get saluted cause not many people is ready to make that sacrifice and sign up from the start.

The statue of limitations is your contract and overall obligation. From the day you started in the military to the day your DD214 is signed. If the test occurs on active duty or during your Reserve time you are subject to action under the UCMJ.
