I am a member of the Wisconsin Army National Guard and currently have a flag in the system for failing my APFT before they switched to the ACFT, what are my options under the new regulations etc to get my flag removed? My sgt said he does not know and says it's very possible that I may not be allowed to take a apft due to covid restrictions,

You can take an apft or acft currently to lift a flag. Pass and the flag will be lifted.

The APFT is still authorized for anyone who has a current APFT flag only.
If your unit refuses to conduct an APFT due to COVID, find an adjacent unit, Guard or Reserve, that will conduct the test for flags.

To add: if your unit is actively preventing you from taking the APFT without good reason, that may be an opportunity to use your NCO support channel and/or the next higher commander's open door policy. If you decide to do this, make sure to do it the right way; inform your direct chain you intend to utilize the commander's open door policy and why. It's a pretty bold move, but it may encourage some action just by voicing your intended actions to resolve.

Unless you're pushing the unit to make unrealistic or unreasonable accommodations, they should have no issues doing an APFT to lift the flag.

Contact your local recruiting office. You can do an APFT with them and they can fill out your scorecard and sign it. Then give a copy to your unit and have it updated in the system to have your commander remove the flag.

You can get an apft from any unit and have the 705 (pt score card) sent to your readiness NCO. I would advise both you and your FTUS(full time unit staff) to call around and ask if you can be administered an apft with another FTUS or even an NCO who can be put onto temp orders. Thank you for the additional information.

FRAGO 1 TO HQDA EXORD 164-20

3.B.11. (U) [ADD] SOLDIERS FLAGGED FOR APFT OR HT/WT MAY REQUEST TO TAKE AND PASS THE APFT AND/OR THE ABCP ASSESSMENT TO OVERCOME THE FLAG PROVIDED TESTING COMPLIES WITH PRIOR GUIDANCE AND RESTRICTIONS
RELATED TO COVID-19. COMMANDERS MAY EXECUTE THE MONTHLY ABCP ASSESSMENT GIVEN THE COVID-19 MITIGATION MEASURES ARE TAKEN. THE APPROVAL FOR TAKING THE APFT OR HT/WT IS THE COMPANY/BATTALION COMMANDER. THE COMMANDER IS RESPONSIBLE FOR THE SAFETY OF THEIR PERSONNEL AND WILL VERIFY THAT COVID-19 MITIGATION MEASURES ARE TAKEN.

Your unit cannot deny you promotion for a failed APFT on the basis of COVID-19 "not being over." Not sure how the Guard works, but that won't fly in Big Army.

I would suggest taking this regulation and getting with your TL/SL during your next Drill (or just call them) and ask them to go over it with you. You can also go to Legal; explain your situation and ask them what your options are.

SPC (Join to see) I would like to add that according to the same regulation, if you had a previously passing APFT score, that should be valid until further notice.

Does your Sgt not get with the training NCO, 1sg and Commander? There has been guidance on this passed down from almost the start of COVID.

The short and sweet of it is that the only ones required to take an APFT are those that have failed one and are flagged. Take it, score 60+ in each of the three events and the flag is lifted simple as that.

Start asking questions in you chain of command then get with the Training NCO or who ever has been designated to take care of the APFT

Everything I've seen is that if you are flagged for APFT you must pass an APFT to be unflagged before you can move on to the ACFT. Currently failing the ACFT will not result in a flag.

If you have a Flag for Record APFT failure prior to the switch to ACFT, then you need to take an APFT to get unflagged. This can be easily administered because per the APFT standards, not including you, 5 people are needed to staff the APFT IOT administer one to you. A Timer and Back Up Timer. An OIC and an NCOIC. A Grader. Social distancing can be maintained by everyone with the exception of the Grader and the one taking the APFT. But, this can be taken care of by the Grader wearing a mask. The person holding your feet for the Sit Up portion (whomever that would be) would need to wear a mask as well. Either way, this can be accomplished rather easily. Pass it. Flag lifted. You switch to the ACFT next time you take one. Easy peasy.
