I have conflicting feelings over this. I know that open carry is a thing in Texas, but who crossed the line, if anyone?

CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.
Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).
Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.
Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

This was unacceptable and any law enforcement officer that participated should be indicted and tried and convicted and do prison time for violating not only their oath to protect the Constitution but for violating the Constitutional Rights of those arrested and physically abused! I have absolutely no use or tolerance for actions such as these!

If they were being peaceful then they were merely exercising their 1st and 2nd Amendment rights at the same time.
Amendment I:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.
Amendment II
A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
The police went overboard, those wrongfully arrested had their rights violated on two levels.

Grisham probably not aware of how many officer have been killed and probably should have followed the officers directive to go to ground as the others did; till the officers cleared up any legal issues about who was carrying legally, just cause your in an open carry state does not mean you cannot be or should not be stopped and directed to assume a position that will allow the officers to make a safe investigation as to fire arms license and legal permit. So as for me, not feeling this guys pain.

Unless you you know that he has committed a crime you have no right to shake him down because someone somewhere else was harmed by a bad guy, so you must be a bad guy too.....assume the position. What's next shaking folks down for a copy of a pocket constitution like the Boy Scouts used to give out (it might offend a socialist libtard somewhere, or how about using my cell phone unlawfully.....I heard someone somewhere had child porn on one.....assume the position will I make a safe investigation!!! Is this really where we are in America? Please don't try to say guns are dangerous and he might do something, that is just your fear talking and the media produced hysteria manipulating the weak minded into staying in their cages.
If he was carrying concealed they would not have treated him the same way. They just don't like what he was doing a fully lawful behavior and exercising his rights. He didn't commit and crime and wasn't suspected of committing a crime why are you and why would you want them to detain him?

Really nothing to be conflicted about, the police chief is in the wrong and put his personal feelings into it and violated their constitutional rights! He needs to be relieved of duty and the officers as well

I am a retired Texas cop. And Vietnam vet. And guns do not freak me out. Open carry people are posers, I get that. But when they tell you to get on the ground, just do it. Sheesh. Make your point later, with an attorney. You do not know what the cop was told on his radio on the way to your event.

Chief Valenciano was definitely in the wrong. I don't mind seeing anyone legally carrying a weapon in the open. What I do mind is a criminal doing concealed carry, that is a reason for open carry. It lessens the possibility for a criminal to commit mass murder. I hope the group had a permit for their demonstration and abiding by all rules. This Chief can expect to be liable for his extreme actions.

Yeah, the thing you don't understand is that they have the backing of the local DA, politicians, people, etc. They'll keep sweeping it under the rug, and they'll keep getting away with it. I would have to say that Bexar county in Texas is indeed the most corrupt in the state. Dare say, more corrupt than New Orleans, LA. Don't taunt the law there, they'll arrest you and kill you in the jail. This is a proven fact.

Unless the municipality has some kind of an ordinance prohibiting open carry (In violation of state and/or federal law), I also believe Grisham was not in the wrong. However, if he was ordered by the police to get on the ground he should have done it immediately and without argument, allowed the police to take the weapons and take them to jail, and then made an issue out of the entire matter later.
Showing Valenciano to be what he is, a thug, and then suing him and the department for false arrest; thus perhaps causing the municipality to have to pay a hefty settlement and probably resulting in the Chief's dismissal, would have been a smarter way to make the point. By refusing to comply, he forced Valenciano's hand and ended up getting himself injured. Now they are liable to try and cite him for resisting arrest. disorderly conduct or something else equally as specious.

Don't give two shits about anyone that open carries. There's no reason for it except to intimidate others. That's the bright line; their 'Rights' interfering with my peace in public areas.
