CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

As a a resident of Central, TX for 10 years now I've seen this behavior from cops concerning open carry (though not this violently). Austin Police Department will detain you for disturbing the peace. Its literally the only thing they've got. They argue that openly carrying a firearm makes the public at large nervous and fear for thier safety. So if you decide to open carry in the Great State of Texas, be mindful of where you do it and the local PD's attitude towards it.

That being said, it is wrong for Police officers to detain citizens who are safely and responsibly exercising thier Constitional Right.

I cannot believe this police chief acted in that manner. Open carry is legal in Bexar county and the chief knows this, he acted on his own, should be fired.

In any case, the best advice when dealing with police is to follow their instructions completely. Disobeying the instructions of a police officer is a dangerous game, right, wrong or indifferent. One can always exercise one's right to sue at a later date. It is the responsibility of the police officer to later justify their actions. Excessive use of force in this instance may be proven, along with false arrest, but disobeying the instructions of an officer puts one in a compromising position. Remember, if a police officer feels threatened they are authorized to ACT. Whether or not that action is justified will come out later. I agree that the mere act of lawfully open carrying a weapon is NOT justification for action by law enforcement.

I hope the corrupt police get their do but being I'm from Maryland I really have lost faith that justice will go to the people who deserve it ,seems in Maryland the police are never held accountable even when caught dont get the sentence that citizens get maybe I'm jaded

So, first off, do not resist. Let the arrest happen. Afterwards, class action suit. The police chief, and ALL law enforcement, should be made to learn about the 1946 Battle of Athens, and heed the warning.

Although Texas is for the most part a red state, we have pockets of blue. One of my soldier is also an Austin police officer who was suspended and threatened with termination for doing his job; another officer had made a legal traffic stop but needed backup from my Soldier because a crowd was forming. It was dark and my Soldiers saw something in the hands of a person in the crowd, he shine a flashlight to see what was in the guys hands. Well it turned out to be a cell phone and the guy was video taping. The guy filed a compliant and then ran to the local news and it became a big deal for a few days, Chief ASSavado threatened to fire my Soldier even before the investigation started. Luckily for my Soldier, Assavado was hired by Houston before the investigation happened.

The San Antonio police Chief has released illegal aliens and refused to work with ICE, despite Texas passing a no sanctuary city law. Several DAs have promised to go after bad cops, many times believing criminals over good cops.

It's a sad and soft world now a days. It stinks that your soldier went through that. The bad guys are getting away with way to much.

SSG Jeffrey Leake - totally agree, Freddie Gray is proof of that. He had 20 pending charges of possession and he was walking the street.

I've known CJ for better then 10 years now. Very few that I know are as tough a fighter for our basic Constitutional rights. I'd gladly stand side-by-side with him if he asked me to. -Especially if his Mrs. cooks dinner again beforehand :-) )
