CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Since this was a civil matter, I would consult with a lawyer, and if you are a member of NRA, you can probably talk to a lawyer for free and possibly get them on your side. I would then find the State Statute that allows open carry (be sure that it includes your ability to carry at an open gathering of people) and take it to the State attorney general. The county should not be able to override State statutes in the same way that States are not allowed to countermand Federal law (10th amendment stuff). Video may show that the police chief had a determination to taze Grisham which would now open him up for civil liability under a number of laws, to include violating one's civil rights and undue use of force. I see civil and criminal cases here.

Lots of people go to jail knowing they were right. The issue at hand is now over shadowed by the fact you refused to follow directions of a commissioned law enforcement officer. Being right don’t excuse breaking the Law.

What was the purpose of the group exercising open carry right?
A weapon is not a prop to use to thumb your nose at a public official. It is a weapon used to kill someone who threatens your life.
We have courts and political representation that is empowered to confront public officials who refuse to recognize state local and federal laws and rights.

Be smarter, more informed and prepared than your adversaries. Confront them on your own ground or if necessary on neutral ground never give them home field advantage.

He sure showed this Grisham guy who's the boss! Hey Chief Valenciana, pay close attention to what's going on here in Florida with Broward Sheriff Israel. You might find it useful in your next occupation.

One someone there may have called the police saying that they were doing something wrong, so the police have to respond and verify. Two if an officer tells you to do some thing and you refuse you are in the wrong no matter what. You did not post a link to the video so I am only going off what you wrote.
