CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Conflicted? At what point are you unsure "what to make of all this"? The Supreme Court has been clear on the topic of resisting an illegal arrest. You have the right to do what is necessary to avoid a seizure of your person by any detaining authority who is illegally detaining you. It doesn't leave you room to assault a police officer who is illegally arresting you. It means you're permitted to escape, flee, avoid by what means necessary an illegal arrest. The guy refused to comply with a police order and the officer had no probable cause to detain anyone.

Sounds like the Chief needs some education on the Constitution he swore to defend.

Apparently this Chief is ignorant of the US Constitution and even sadder is the fact it appears that he doesn't understand the Texas Constitution. Either he's jealous of this Individual successes or apparently a Liberal (DumocRAT), a Closet Lib (Rhino), or just a Person who doesn't respect the Rights of others. Bottom line, I'm sure there is Witnesses, Photo's, and Evidence that would prove potential Police Brutality I would turn it over to the Texas AG and demand a DOJ Investigation..

Are we a nation of laws, or not? Are law enforcement officers going to be allowed to defy the legislature (law makers) and make up their own laws, or not? Are we overdue for a revolution, or not? Just asking, 'cause I was really kinda curious.

CO is also open carry except for places like Denver where they do not allow open carry unless in uniform (i.e. security officers) and I also have concealed carry in CO which comes in handy in case a jacket covers the view. There are a lot of power hungry officers out there.

I mean.. this person is lucky he’s of a low melanin account and wasn’t killed during this process. But if you think this is poor inexcusable treatment, you’re gonna lose it when someone explains that certain communities in America face far worse treatment, relatively consistently.

Clearly, the police overstepped their boundaries.

When a police Officer directs you to get on the ground, get your pampered, entitled ass on the ground. My guess is that dumbass Grisham was arrested, for resisting arrest and not open carrying in Texas. That ignorant dumbass went looking for a fight and is lucky he still has his teeth.
If the police officer steps over the line, it's better to contest it later, at the police station while you haven't been arrested for being a dumbass and still have all your teeth.
It's a shame the military can't come up with a test of some sort that screens out wannabe and actual domestic terrorists.
