CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.

Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).

Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).

Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.

Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

The 2nd Amendment is a mixed bag. The point of it was to protect our nation from tyranny. Yet, we elected Tyrants into power since 1980 onwards who have done more harm to America then helping it. The fact is that Firearms were also tied to Military/Militia Forces; that every able bodied person who was over the age of 18 was supposed to serve in uniform to protect the nation.

Again, we need to look at the fact is that there's plenty of individuals whom are unfit to serve as well as unfit to own firearms as well. We took the model from the Scandinavian Nation-States and the UK; in that those whom were unfit to serve were unfit to own firearms; which is why those countries have less firearm/gun violence then the USA does.

The fact that anyone can get a firearm and bypass proper legal ownership laws is perfect example with Kyle Rittenhouse (a Domestic Terrorist) who was armed by his friends/family and given a pass on committing murder because of his age. Either he's an ADULT and tried as such or he's a juvenile and his parent(s) need to be held accountable for his actions. The fact that law enforcement allowed him to murder people engaged in their 1st Amendment Right. Which has been eroded by Evangelical White Nationalists thinking that we're a White Christian Nation and clearly failed basic social studies and history classes. Then again 40 years of Dumbing Down America and undoing all the great things done by every President from FDR to Carter was thrown in the dumpster by Reagan, Bush, Clinton, etc.

If we're going to support the Constitution it includes either making mandatory state service (military or otherwise) as law again (WPAs and other programs) Which grants the legal right to own firearms as part of military/militia. OR we need to change the 2nd Amendment to stop letting the mentally unfit and other dangerous criminals have access to them because some morons need guns to protect themselves from The Government whom are clearly aren't fit to own them to begin with.

Qualified immunity is written for what we as humans aspire to be (it assumes we will act with integrity and honor when no one is watching) it doesn’t account for the frail egos of a lot of us when we are confronted by some unwilling to bend to demands that are unconstitutional.

This should now be a matter for the Courts. Our Justice System provides that, after Law Enforcement has acted, the actions of all involved may be put before the scrutiny of the Court; at this point, a judge will need to decide, unless there is also a jury involved at which point it becomes a team effort.

The accused need to be careful and meticulous in their defense. They are innocent until proven guilty. With that said, the State Prosecutor will do what has to be done to make that happen. That's the job. Now, the Defense Attorney needs to figure out a strategy to bring the truth of the matter into the courtroom.

The phone conversation might be a good place to start. Also, LEO body-camera records would be helpful. Normally, I support Law Enforcement; we all should. In this case, the Court needs to sort this out and render a judgement.

Even in "red" states you have "blue" pockets and Bexar County is on of those "blue" pockets. For all of those saying "well he should have known that was going to happen even though he could" .. shame! For too long the 2nd Amendment has been treated like an afterthought right.. it is not! It is no more less important than any of the ten (yes ten) that make up the Bill of Rights and the additional Amendments henceforth. Whenever you hear folks saying they are after your guns and the 2nd and you discount them, you need to remember these moments and reconsider your thoughts because every time they get away with stuff like this or the b.s. of "closing loopholes" or "commonsense gunlaw" what ever it is just one more chip off of your rights that they have gotten away with and are moving on to the next. Pretty soon you'll be stuck holding the tootsie roll pop lollipop stick after Mister Owl showed you it took three bites to get to the center.
