I was promoted into a different unit, do I have to stay the 12 months with them before I can transfer?

I need some clarification on something. While I was on ADOS orders I was promoted to E6 effective date 1 JAN 15. The promotion reassigned me to a different unit, but the transfer order didn't come until much later with effective date of 31 DEC 15 because RLAS was down. I'm trying to transfer units but they're saying they won't let me because I need to spend a year with them.

Technically no, the gaining unit can transfer you for any reason. But you as a Soldier don't have the option, it has to be initiated by the unit.

CSM William Payne - More than likely, since he didn't get transfer orders until last month, they promoted another Soldier into the slot before he was ordered to transfer there.
Again, improper coding. It should have been coded "vacant, but reserved for a deployed (ADOS) Soldier".

1SG (Join to see) - correct, that was what happened. When I went to go visit them in person trying to get the transfer done even one of their civilian HR personnel said I wasn't obligated to transfer there since transfer orders wetr never issued, but by that time the transfer paperwork had already been signed off on by my old unit and this gaining unit so it was too late to just go to a closer MI unit. They'd promised to help move my packet forward in tour of duty so I could remain on ADOS orders here at Gordon, but once the transfer was effective I got almost zero assistance from them with getting my packet finish in tour of duty and the last day of january HRC decided to stop extending my orders while we tried to finish getting the tour of duty packet finalized so over the weekend I found myself suddenly off orders with no time to demob. They didn't respond to my emails or phone calls until mid-february, which has sort of given a bad impression on how I can expect they'll take care of me if I'm forced to stay there for a year before transferring back to an MI unit.

SFC (Join to see) - I'm speculating here, but I would guess that someone in your CoC is hostile to you being on their UMR and on ADOS orders. This happens a lot. There was probably some internal deliberation going on, hence the non-responsiveness.
Guessing further, they're probably going to play hardball until you report and put a human face on the issue with actual leaders, not just the UA. Figure out what tack you want to take (hint: don't use sympathy. They won't have any.) and give it your best shot.
If they say no, you're stuck unless you want to risk the promotion being revoked and them collecting all of that E-6 pay if they're really feeling vindictive.
If you are destined to remain there, win them over with your qualities as a Soldier. Right now, you're just a name and an SSN on the UMR. Make them see that you are more than that, and readdress the issue again down the road.

SSG Kirkpatrick, as an "Old UA" I would say that you should stay with the new unit at least 12 months. Please keep in mind the whole idea for cross unit promotions is to infuse new blood into the unit and to assist in your professional development. Yes you are outside of your comfort zone but that is a good thing because that is when you will learn the most. I am not saying never go back to your old unit if there is an opening, but give the new one a chance. New unit with a new promotion....what an adventure.

I work as a UAT in the Reserves and I've seen it work if the Commander of the unit you were promoted into writes a memo allowing you to transfer prior to the 12 month mark.

The wise solution is not to burn your bridges, yes you want to transfer, but you need to stay and fulfill 12 months. Needs vs Wants decisions wisely made makes friends the opposite makes opponents.

SFC (Join to see) - The best answer is for you to clarify this with your commander, because in actuality the CO makes the decisions so use your chain of command wisely. Make friends/bridges.

CPT Pedro Meza - CPT M....I agree in part with your advice except I would send him first to the 1SG or NCOIC. Work the chain of command and NCO chain of communication....old concepts but ones that have stood the test of time. REMEMBER: Good NCOs prevent Officer Harry Karry. ;-)

Agree completely with both of you, my intent is to take it up with the HHD 1SG first as the last thing I want to do is make matters worse for myself if anything comes off as jumping the chain of command.

It may be different in the reserves, but on Active Duty you can be promoted and transferred the day after or vice versa.

In the reserves normally when you get reassigned when promoted a transfer order comes at the same time the promotion order does, both being cut by our personnel system called RLAS. Last year around November-January RLAS was down, so my promotion order had to be done manually, and so a transfer order never followed. They finally got the transfer order done, but with an effective date of 31 DEC 15. I came off ADOS orders at the end of January 2016 and found an MI unit (the one I was promoted to is a support unit) here at Gordon who will take me, but the unit I was promoted to is denying my transfer saying I need to serve the 12 month period outlined in the promotion order first before they will release me for transfer, but that 12 month period, at least what I'm told, goes from my promotion date, which was 1 JAN 15, so a year from that is 1 JAN 16 which has already passed.

I had sorta of the same thing. My commander had to release me and say that I could transfer without issue. The reason should be a valid one, like you have. Good luck

To help clarify, my home unit was back in Ft.Worth, when I came on ADOS orders I PCS'd here to Ft.Gordon in Georgia and now work here full time as a DAC. The unit I was reassigned to is a support unit out of Ft.Jackson, which I found odd since there are MI units here on Ft.Gordon they could have reassigned me to instead which would've been much closer.

So...you're double-slotted in a unit at Ft. Jackson, your civilian job is near Fort Gordon, and there are units there who have openings where you wouldn't be double-slotted. And you're USAR. Do I have the situation correct?

CW3 (Join to see) - Correct Chief, since I came off ADOS orders I took a DAC position here on Ft.Gordon, so I wouldn't have been able to return to my old unit in Texas anyways. When I was promoted they reassigned me to the unit at Ft.Jackson, but since RLAS was down at the time my transfer order didn't come with my promotion order, so by the time they got the transfer done nearly a year after my promotion date they had already filled the slot. They still transferred me in, but now I'm double slotted in the position, and there are units here at Gordon who have open slots where I would not be double slotted. They are denying my transfer request due to the 12 month obligation to serve in the position with them in the promotion order, my promotion date was 1 JAN 15 but it seems like they want to go off my transfer order date which wasn't until 31 DEC 15 (which should have been 1 Feb 15 if RLAS hadn't been down last year).

I'd say if you really want to push it, go to the IG and show both orders, and ask the question on which order takes precedence. If you live near Ft. Gordon but are drilling involuntarily at Ft. Jackson when you could be drilling at Ft. Gordon, AS a SSG, that's an issue.

CW3 (Join to see) - Thanks Chief, one of the recommendations I got from the UA at the unit I'm trying to transfer to suggested filing a request with the IG to see if the transfer order could be amended to reflect what the transfer date should have been (1 FEB 15). Going to wait until next weekend when my new unit has BA and see if I can talk with the 1SG/CDR about the situation face to face, if they seem steadfast in keeping me there then I'll take it to the IG.
