It all depends on the details and specifics. The surviving spouse needs to contact the VA to verify what they are eligible for. https://www.va.gov/family-member-benefits/

I had read that already. It is co fusing, from my understanding we are not eligible. He was medically discharged 2 and half years ago, and he now receives 100 percent disability pay

Alice San - If you do not understand the wording on the website, call the VA and talk to someone. They will answer your questions or point you in the right direction.

MAJ (Join to see) - Or speak to a VSO. It would be smart to submit an Intent of File, that way if it takes a while, they will backpay to the date it was filed.

Alice San - I would recommend reaching out to the VA to verify.

General, Yes if the cause of death is related to the service connected disability, if the service member was 100 percent for 10yrs. or longer the survivor benefit remains the same as what the veteran was receiving

Yes... but my husband's greatest disability percentages comes from back injuries, ptsd, and knees injuries. I doubt anyone can die because of back or knee pain

In my parents case my father died from a stroke, he was 100% due to back injury and chronic pain, because he was rated at 100% for over 10 yrs. my receives the same amount as a survivor benefit. Each case is different the time line is what secured my mom’s payment… hope this helps

RE : "...if the service member was 100 percent for 10yrs. or longer the survivor benefit remains the same as what the veteran was receiving ". I have a friend, 100% service connected disabled. Are you saying that after 10 years of marriage and his death, his wife will get his FULL disability pay? I can find no such thing on the VA website

Alice San Good question. I'm not sure I have the correct answer so I will let someone else who is sure give you the details.
