If my mother refuses to move although my orders say she is authorized to move do I get BAH at her location or my duty station location? I love my mother but I dont want to live with my mother I'm almost 30. I am being told that when I go back to CONUS she will need to move with me and my BAH will be at the new duty station rate and if she refuses to move then I still get that rate and I would still be responsible for her home mortgage and my own off post housing since I am not authorized to live in the barracks because I get BAH.

The implied part of secondary dependents (DFAS term for your Mom, provided she is in DEERS as your dependent) is that they are so bad off they live WITH YOU. The second you draw BAH, you are ineligible for a barracks space. BAH is always the duty station, with the one exception being unaccompanied to Korea, then youd have to pick where she will go, and that is the BAH. Location enumerated in orders.

The mortgage, a rental, different locations, refusal to move, all irrelevant. Those are issues for you and your Mom to work out. You requested to add your Mom as a dependent. DFAS granted your request. You are on the hook to provide that support. This is the Faustian Bargain

Is your mother is actually your dependent you will get BAH. The question is if your mother is in your dependent in DFAS?

SPC (Join to see) Okay, now I understand. Your BAH will be dependent on your duty station. If she resides someplace else the military will still have to provide housing for her at your duty location. You will still be able to keep her enrolled and Tricare at her location.
