My wife and I are being sued by a sub-contractor who did work on our new home and was hired by our builder. We closed on the house on 28 Feb 2020 where the builder received final payment but did not pay the sub.

Your lawyer at closing had a responsibility to verify that the builder had paid all bills related to your home. Most lawyers assign this duty to one of their legal aids who uses a form that the builder has to fill out (including names of all subs) and to verify that they have been paid. Then the legal assistant must phone all (or some) of the sub contractors to verify payment. If this form was used, then your lawyer has grounds to sue the builder (because he has some responsibility to do his job). Pressure your lawyer.
