The Texas state law is that seventeen is the age of consent, so a 16-year-old could not give consent. She could marry the PV2 with her parent's permission, since she's older than fourteen.
Here's a table of the ages of consent for marriage, by state:

Does the UCMJ impose a stricter rule on consent to marry?

Neither of these answers is "for sure," SSG (Join to see). Your family member (or you) would want to talk to a military lawyer for a definitive answer.

Chief Montgomery is accurate about her being able to marry in Texas as long as HER parents sign a consent form with the county clerk in order to issue a valid marriage license. UCMJ doesn't have any restrictions that would otherwise preclude the state law being applied.

Texas The age of consent is seventeen. With parental and judicial consent, parties can marry but not below the age of fourteen for males and thirteen for females. Common law marriage is recognized.
ok, i read through it and it does say that with parental and judicial consent it is authorized, thanks Chief for the data.

To the best of my knowledge it's 18 no matter what. The states age of consent doesn't matter.

This is my conundrum... this (again) is what I have been tracking for years. That regardless of the state laws, UCMJ still requires her to be... ?. I think the PV2 in question is robbin the craddle per se'

I would run the question through the base JAG office for the definitive answer. I would even try to get a Memorandum for Record or email answer, just in case there is someone down the road that causes trouble. That being said, all my friends in JAG tend to err on the side of caution.

The minimum age of consent for the military is 18, whether its girlfriend or wife. Military is a federal entity so it doesn't go by state laws. The question came up several times in my unit and and this is the response that came down from our CoC, usually via safety briefs. I don't know the regs for it though so I'm only going off the warnings we received many times.

I believe it depends on the state they are living in. The military doesn't "marry" people. That is the pervue of the state.

SSG (Join to see) - I believe you would need to look at what the legal age of consent is for the state of Texas. If she is not that age, then she cannot give legal consent by herself to the proposal. She would need the consent of her parents. I don't believe UCMJ put additional restrictions on this, though I am not 100% sure.
