The question is since i was denied the O1E pay as a newly appointed officer on AD, would i technically qualify for O1E pay as a prior ?

Per the DOD 7000.14-R DOD Financial Management Regulation on 1-11 it states," 1. General. Commissioned officers with over 4 years of prior active
service as an enlisted member, warrant officer, or combined service in both grades are entitled to
count such service for purposes of computing basic pay for longevity purposes. Such prior service
includes all active service, in either the Regular or Reserve Component or both (i.e., ADT in
enlisted or warrant officer status, annual Reserve training duty, and full-time National Guard duty).
Service on active duty or ADT and IDT for at least 4 years and 1 day satisfy the over 4 years of
service requirement under this section".

I get that initially it says that it must be ACTIVE FEDERAL SERVICE of 4 years, but then it does say Reserve/IRR/IADT etc. does count. but as you read more it says that it doesnt. i am hoping someone can clear this up for me. I was told to get a DD 1506 done if i think i was wrongfully denied this pay.

It's Active Service. You have had periods of active Service in the Reserves. The reg is referencing those periods such as IET training, Annual training, or any periods of activation. If the cumulative time of your periods of active duty exceed four years, then you are authorized. The DA 1506 is used to compute your time only of your BASD is incorrect, it's not an appeal form for pay inquiries

There is two statuses to discuss here. The E pay has historically been four years and one day or 1500 points and if you were not going in to your reserve unit every day like an active duty soldier, then you come no where close to getting E pay. Now you should be getting paid for over six years time in service which is all the years you went to drills and is different than E pay. I am at 19 years towards federal retirement but my LES says 23 because of time in the guard.

That what was not told to me when i was at finance, but thats what i was assuming would be the case. I have the constructive credit given based off the civilian nurse experience from my time in grade and then with having over 6 years i would be entitled to O1 pay with 6 years of service without the extra kicker of E pay due to not meeting the 4 year active federal service obligation.

Look at your RPAS statement. It will show your Reserve time which can be converted to AC time.
