What do you do when a soldier refuses to listen to your directions?

This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?
Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.
On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

As a no coom youo may disiline the solider directly wi th ushus or other hysical taining, if the sunglasses are NOT Medical Nessasary. you can reort him/her as bieng out of Uniform . briing it to your command Sgt major and let them take it futher,

I find the Soldier after formation when there isn't as big an audience and we have a frank talk about oaths sworn, duties charged, UCMJ and other topics..?

You put it on paper, hand out "group punishment"; report it to the officer in charge; then begin to make his/her life hell with every dirty job you can; tell him/her that this purile little act will be remembered for a long time. In the old army he/she would not have worn them in the first place let alone defy such an order. He/she would have been given a "sgt.s article 15". The nco's would have taken him behind the barracks. When I was a sgt. we did this once and never had another problem.

Raise you voice, get up in his face and Once everyone understands that there is a problem child, you have many witnesses to the insubordination, and you snatch them off his pretty little face. Now you have grown some NCO balls, and you gained some respect! Then just add a little salt, you write his ass up! Getting attitude from pretty boy? Have him meet you out back and you bust his lip. End of story.

1. Ask if they have a medical reason for refusing - eyes dilated, or recent surgery where the doc has directed them to wear sunglasses. If they do, they fall out of formation because you can't have sunglasses in a formation. End of story.
2. In the far more likely scenario they're being a duffle bag, then you have a variety of options varying from chewing them out on the spot to writing them paperwork. Article 92 is a nice catch all since it's "failure to follow orders or regulations and violation of orders/regulation'". Even if the Army doesn't have a specific reg to cover sunglasses in formation, you ordered him/her to take them off and they refused a lawful order. You can also take the track of making their life a misery but that takes a lot of your time and supervision. Personally, I prefer helping such folks out the door vs. taking up a majority of my time which should be spent on developing promising people vs. troublemakers. Most of the time we spend 80% of our time on the lowest 20%. I prefer to spend 80% of my time on the top 20% instead, since you wind up getting better results that way.

First, remove the soldier from the formation and have him/her in the front leaning rest position until the formation is dismissed. Then counsel the sm the proper uniform for formations. Corrective actions can be additional uniform inspections in different uniforms. This can go on a long time, but make sure the sm knows what time and where to report in the uniform assigned. Follow-up with 4856's for every infraction. I did quite a few push ups in my time and never made the same mistake again.

As the little puke has forgotten he/she is now government property, you take them, destroy the contraband, and if he/she touches you in the process you ‘defend' yourself and have them brought on assault charges via an Article 15.
Unfortunately you gotta play the new Army game, write em up till they can get separated... Not worth losing a chevron because of these immature pricks nowadays, I like my job and I have a family to care for. Not worth the drama...
