What do you do when a soldier refuses to listen to your directions?

This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?
Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.
On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

AR 600-20 is a wear and appearance of the uniform it does not list disciplinary actions. The first offense should be warning and you could even give a second warning however on the third offense you really should issue a letter of concern listing the other offenses as well. If he does it again after the letter then refer him to the Commander or First Sergeant for further disciplinary action. You may file an DA form 4856 (Personnel action) in your referral if you desire. But keep a copy of everything for yourself in case you need it later. As a good NCO you need to follow the advice of your senior NCO's and Officers and head their recommendations.

Correction the DA Form 4856 is a counseling form. You can file this of a letter ofconcern they both work the same way. Always build a file and do the paperwork as SSG Jordan suggests.

When a sm does n't listen you put on a 4856 failure to follow orders article 92 under UCMJ. You give that troop corrective training. If they still refise you build there packet with 4856's and get there ass out the door. You have to do the papper work. Every Chain OF Command will back you. A bad apple if not dealt with can spread, It affects good order and disclpine. Also all 4856's should be kept in there packet so when time comes for Article 15 it is in order. If you need more help with this let me know.

I'd use some physical punishing. Tire the soldier out with some squats, sits ups and lunges. If they continue use paper. Most soldiers know a counseling don't go anywhere and don't do anything. But if they are truly a pointless soldier you'll need a paper trail for ucmj.

This is a good question. I never encountered someone not following my directions. I don't agree with removing the glasses and destroying them. As an enlisted sailor when I saw a form of disrespect, I would talk to the individual to understand why. We policed our Petty Officers and Non-Petty Officers on our own and we all knew that we didn't want the issue to be bumped up to the "Chief". If an individual refused to conform after many informal and formal counseling sessions, the issue would then be referred to the Chief. As Leading Petty Officer, if I had a difficult person, I would speak to my Chief for advice on handling the situation. Most times the situation was handled and things were worked out. Writing someone up for being disrespectful should be the very last step if all else failed. As a Commissioned Officer, I relied on my Senior Enlisted (The Chiefs) to handle most issues. No one was ever referred to me for disciplinary action. The Chiefs handled it and I backed them up.

I say I you PT him till he understands. If he is a younger enlisted why mess up his career over this. I understand as a lower enlisted you have to listen to the orders of NCO but why mess up his life?

Why set yourself up for scrutiny of destruction of personal property or improper contact. .......why cause yourself the headache of all the additional paperwork and time because some yo-yo has no respect for authority or well being of the rest of the formation. .....what kind of leadership are you displaying that they will remember at a critical time?
As a first sergeant, I didn't yell, issue petty threats or loose my composure because some yahoo doesn't understand the meaning and responsibilities of wearing the uniform no matter what branch!
So how would I handle this situation? I would have someone get a chair for him/her to sit down while the rest of the formation pays for the penalty of the soldiers insubordination. I would ensure that the soldier was comfortable and understands that when one person makes a poor choice it affects everyone.
Guarantee that the rest of his/her buddies will get the message across to them.
Very good communication tool.
