This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?

Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.


On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

As a private I would have preferred wall to wall counseling over Article 15. Ignoring the prescribed uniform is against the uniform standard and needs to be immediately corrected. If the soldier has such a poor attitude to not comply then roast his ass. That private has become your personal detail rat. If he self corrects then no problem. If he doesn't then if he doesn't and ends up going through summary, company, field grade ART 15s and is exited. It doesn't matter the rank either.

yes it's called refusing a direct order--- if you stand there and look stupid what do you think the other troops will listen to your order's ahhh no they will not example -------if your in a battle and you tell the troops to move forward and don't---- who the fuck is in charge

GIVE a written counseling and let him Know that not acceptable and if it continues that you will recommend UMCJ Actions. And you might also I am the one charge and you will listen to what I say.

I think the politically correct answer is you get him flowers, take him to breakfast and ask how he or she feels. In reality write them up, the former post was completely accurate, failure to obey a lawful order

still refusing a lawful order by a non commission officer period. yes i would recommend USCJ action depending on how many times the soldier as been written up for misconduct

First call the formation to Attention walk to soldier take his glasses off unless he has a written updated profile from US Army Doctor says he is On A profile and his glasses or sun glasses are of US Army Regulations and is authorized to wear them. When you go to soldier in question you ask for his Profile or Authorized permission. If he has it then you makesure that he to make copies and give to chain command. If he can not show evidence or has forgot or whatever excuse??? Then you I am going to take your glasses off put them in your pocket and then say after this event or after commanders formation you ask him to come see him after formation to collect his glasses and to get profile or Doctors note. If he can't produce or have with his Team Leader, SQD Leader his chain of command sit down go over this with him rules regulations. Then a counciling statement with the SQD Leader, Team Leader is present with there discussion and signing the council statement. You keep a paper trail on the conduct and behavior plus all the good, bad, ugly. So there is a paper trail so when it's time for a AR 15. UCMJ. Field Grade or Company Grade. You have had done your part as a Leader to show him this is how it is done. So when it's time for anykind of punishment etc. You have a paper trail that has followed him from Basic Training and as he goes to different units or assignments or orders for schools it is all in his file and now if he goes to IG or goes above chain of command or chaplain you have all these statements to back your talks, punishments, anything this is the right way because if the Army wants to boot him they can see all of the statements to put him out of the Army. By chance if this soldiers has a permanent profile and you asked him to take off glasses and he said no and he explain then he has the right by rules and regulations US Army policy doesn' have to take off glasses even there was a direct order from the highest in command because he would be breaking his permanent profile which he can be In more hot water for breaking profile. It's all about getting to know your soldiers more. Call on each soldier individually with his individual file ask all the questions and get to know his weaknesses or strengths. Profiles. Where he wants to go and what he or she wants to accomplish and any other concerns. At that time you give your speech on how, what ,where, when, of your expectations. Then you make sure this soldiers records or file is up to date on profiles, allergies, heat/ cold casualty. Then you make sure he has at least two copies with his I.D and Dog Tags. Up todate military drivers lic, state lic, insurance , registration etc. Religion etc... all this stuff.!!! So when you are in a formation or some where you know what's going on and you can look at soldier because now have established a basis and first council statement of your expectations. So if your soldier has brain fart you can just call him to side of formation and ask if he is all right or just do not want to comply . That is when you can drop the axe. It takes alot but if you know your soldiers and another NCO or Officer dogs out your soldier then you can back your soldiers rights and can make it stick. If you do not know your soldiers you have failed them and you have set yourself up for failure and when shit hits fan there might be two people in trouble or loosing rank than just one. It can all be avoided if you sit together as a CO, PLT SQD, Team or Individual soldier to get to know them and they learn to respect you are making the decisions or knowing what is right and wrong. I have been in 12 yrs and pays to know your rules, Regs, DOD policys, FM's, AR, UCMJ. Any way if you give orders it pays to know your soldiers because if you give an order and you are looking like an Ate up cheese burger or chewed up bubble gum. Others will know you as an individual soldier Lower Enlisted or NCO, CO will be replaced or transferred if you can't cut it or you fail as a leader or you just have nobody's respect comes with territories of born leaders and people skills.

First I'm going to take a picture of the soldier in the unauthorized eyewear. Then I'm going to come up with an immediate painfully mind numbing or time wasting errand that the soldier will be doing so that his peers see an immediate response. This will not be Snuffy's actual corrective training though. The first bit is something that he just "volunteered" himself for, but has to be immediate and in front of how peers because of his challenge to authority.
When Snuffy comes back later the 4856 will be written up with the magic statement included. For a first time offence I would discuss why it is important to follow orders, taking up lots of his free time. Then I would have him suggest his own corrective training. If I like it, I'll go with it. Otherwise I'll assign him his own duty, such as writing up an essay on the importance of following orders and the chain of command. It will be due to the CQ desk that Saturday, where I will pick it up. The Article 15 will be mentioned but probably not pursued unless it happens again. And hey, I've still got that photo evidence of the initial uniform violation so the case is already being built. Next up, extra duty and loss of pay. Don't make me go there private!
