This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?

Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.


On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

Step one remove soldiers sunglasses. Step two administer extra duty assignments that inflict pain into soldiers body. Step three fill out paper work on soldier so that you have a paper trail to use in further punishing them next time they decide not to follow a direct order from a NCO.

Cpl Benjamin Long - Basically what the 1SG said was deal with the soldier without causing pain in his or her body. Use paperwork and counseling and that's it.

SGT Connor Haynes - ah, I see SSG R W is attempting capitalize off you saying cause pain and 1sgt not causing pain... well to fix this logical paradox.. is that CPL Haynes poorly stated pain does not fall into the realm of assault or in the boundaries of the Federal torture act under USC Title 18, and 1SGT explained no pain.. I see no difference here... since CPL Hayes idea of pain is extra work... nice try SSG... but redefining people's statements is dishonest..

I had a CSM in NTC, called the MPs and had a soldier arrested and hauled away that refused to obey his order. I think if you are the senior rank that is the correct step, if you are not the senior rank, stop, bring it to the attention of the next higher rank in your chain that is there. Once the soldier is arrested for disobeying the order. he or she is smoked, legally.

Showing-up with sunglasses is an asshat move that should be remedied with a simple conversation. Refusing to remove them is refusal of a lawful order & should be handled as such. This is a case of insubordination. You were in formation, then uniformity is important. A commander not willing to support an issue involving insubordination is not worthy of his or her rank. You are not throwing the book at a uniform violation (which should never occur outside of basic training), you are dealing with insubordination. It's a much different situation.

Put it on paper, failure to follow a lawful order, the soldier is attempting to get a rise and troll the system . Just smile recommend UCMJ take the money and the time. At this point I don't feel that corrective training is appropriate, but a superior or company grade depending on the level of immaturity displayed is.

put on paper but just dont let it go unpunished, as you said trying to get a rise, well give the results, with njp, as long as the sm serves and gets away with conduct the lower as well as higher enlisted see this now your authority is at risk, so use your advisors jag and the commander, make the punishment fit the offense it is a new army but there are still ways

I would make the whole platoon do push ups while he stands at attention . And when they get tired and angry enough at him / her, the problem will take care of it's self.

As much as I like the concept, there is a big problem that comes with it. It could lead to physical fighting within the unit; bad for morale and cohesion. The individual could also successfully press assault charges against the others if they try to handle the problem by physical means.

My first thought was to take him to the CO for disciplinary actions. Article 15 etc..... I guess it has been a long time since I crossed to the officers side. On a second thought, it's too early for that. I will order him to take them off a second time. If he refuses he would earn every single shitty duty I can think off. Especially in the weekends when everyone else is off. I would also ask other platoons sergeants if they have any shitty duties to be done. I will keep at it for about a month even if the problem is fixed right away

In the Fleet we trade freedom for brutal manual labor... That pretty much always solves the problem
