For example, something I have experienced in the last few weeks was a field grade Commander of a unit who tried saying he did not have to comply with an OPORD endorsed by a Post Commanding General because he was paid by USAR and complying could mean an ADA (Anti-Deficiency Act) violation. This is embarrassing not only to his unit whom he would like to say he commands, but all of the Army Reserves who from my experience have mighty fine officers and some great character throughout my ride in the Army.

Here is the joke. Is his superior HQs, current unit, current job, mission, overhead, salary, and reserves federally funded? Yes!

I think he is saying that using reservist funds for salaries on active duty breaks a principle of Fiscal Law of Purpose. I am pretty sure he gets Active Duty funds directly or as an reimbursement. Precedent is against him as hundreds of thousands of Reservists have served on Active Duty status. So here are the ADA rules:
1. The price cant be excessive
2. You can't buy if you don't have funds
3. The purpose for what you are paying for must be appropriate
4. You cant pay one fiscal year for a purchase in another fiscal year unless it's for construction.
He is using #3 to act like an officer who needs to be reamed with the upmost urgency and painful manner.

In this regard, he is refusing to comply with Army training resource utilization requirements of classrooms supported by the installation. If everyone acted this way, his classrooms would have no electricity and his students could be turned away at the front gate by personnel who could claim they're not there to support non-Active Duty personnel. I could go on, but we've all got the point already.

Had our air support unit call up to our ODA's TOC and our Air NCO launched the Air Weapons Team 12 hours early because he (our Air Guy) mistook what they were asking (along the lines of when our SP time was) for a logrun that had left 30 mins prior. That resulted in two Apaches and a Kiowa taking off and spending 45 minutes looking for our convoy...that wasn't there.
