Hello all.

Late January of this year I was demoted from PFC to PV2 due to a field grade article 15. I have since carried out the given punishment. My question is since I have now been active duty for 2 years (February), when should I expect to be eligible for promotion to SPC? Currently I am still at E2. I have asked my PSG several times, he hasn't given me an answer. Thanks in advance.
If its a matter of TIG, what can I do to receive a waiver?

It is a matter of time in grade for both PFC and SPC.
You are eligible for automatic advancement to PFC after 4 months time in grade since your last reduction, assuming that you are not currently flagged and otherwise administratively eligible.
Once you are advanced to PFC, you would be eligible for SPC after 6 months time in grade as PFC.
Currently the limit for waivers to SPC is 25%. No doubt the top 25% in your BN do not have a field grade ART 15, so I imagine you are not competitive for that.

Accurate, I can confirm from experience sadly, you're gonna be waiting till you hit TIG to PFC again! and then TIG to SPC all over again. Trust me it sucks man. Don't give up on the waiver tho, you have to really impress your leadership from here on out if you wanna get back on track.

PFC (Join to see) - soldiers who have been reduced under article 15s are not eligible for waivers. He's going to have to serve out the full TIG for E2 and E3.

PV2 Lazerez,
Stay resilient and your time will come again. The most important thing it that you learned from the past and can now perform as a standard bearer in the United States Army. If this is the case, and you want to make up for a set back you had with the FG Article 15, I would say to start taking correspondence courses for your MOS, study skill level 1 and 2 tasks and take some online college classes. Get your EIB and or Soldier Expert Badge. Stay motivated and look at the positive things about your career.

Since you got demoted due to Article 15, you are no longer allowed to be given waivers for your advancements. As such, you will need to meet the full TIG requirements for advancement to PFC and SPC. And that clock started on the day your effective DOR to PV2 started.

".,,,.The Soldier regains promotion eligibility on the day of completion of the period of correctional custody, suspension, restriction, extra duty, and/or suspended forfeiture of pay, whichever occurs later. For the purposes of determining non- promotable status, periods of forfeiture of pay will be determined as follows:
(a) Periods of forfeiture are to begin on the date that UCMJ, Article 15, punishment is imposed.
(b) For UCMJ, Article 15, forfeitures imposed by company grade CDRs, 7 calendar days is the period of forfeiture. For example, punishment is imposed on 28 March 2005. The Soldier is in a nonpromotable status from 28 March through 3 April and regains promotion eligibility on 4 April.
(c) For UCMJ, Article 15, forfeitures of 1 month by field grade CDRs, 15 calendar days is the period of forfeiture.
(d) For UCMJ, Article 15, forfeitures of 2 months imposed by field grade CDRs, 45 calendar days is the period of forfeiture...."

When should I be eligible for promotion to SPC, given that I have 2 years AD, but was recently demoted to PV2 due to a FG article 15?

He haven’t answered you because you just got reduced. Before you ask when you are eligeable for specialist, earn your Sqaud leader and commands trust. Then you will have to wait until you meet TIG requirment for PFC. one step at a time. I would not be pushing people on promotion, prove you are worthy.

Field Grade Article 15 with reduction in grade is pretty serious, the next serious step up I believe is boot from the Army. Your lucky your getting a second chance. When you fall like that your PSG gets verbally beat up as well at a minimum, so he might harbor a little residual anger over that.

Well first thing first if the punishment has been carried out and there are no suspensions pending then you would need to work towards earning back the rank of PFC again and once that’s complete then you would have to do the same for SPC the common misconception is that being promoted to SPC is an automatic because you have been in the Army for two years. That’s false I myself have denied promotion to the rank of SPC because I felt the soldier was not ready or deserving so you might want to think about that stud

My honest suggestion would be to just do your job and be good at it and you'll be a Specialist in no time. If you sit and complain, get lackadaisical, and do the bare minimum then expect to wait the full time it takes to become a Specialist.

The senior Enlisted below are right on track with what you’ve got to do and or time you’ll need to wait. Also as a prior commander, depending on the severity of your actions which had to have been enough to force a reduction in rank. Not to mention that the commander didn’t see it fit to put stipulations in place to write up and inform you of the article 15, however putting stipulations in place that would essentially Allow them to put the article 15 on hold as long as you met certain requirements that they set forth.
All in all just reference the regulations as listed above and make sure that you follow the chain of command when inquiring about this so as not to cause any more waves. You may also possibly request a one on one with your PSG and or PL to discuss the matter, if such action is taken it would be who’ve you to make sure you go over the regulation prior to and or possibly print it off and bring it with you so that way you can reference what you were trying to tell them and also make sure that you are meeting and or exceeding all requirements that are being asked of you which should be notated within your counseling statements whether they’re done monthly or quarterly, they’ll tell you where you stand. Good luck to you and whatever happens stay the course and learn from your mistakes Which ultimately makes you a better soldier and the skies the limit.
