Okay so not so recently I had been flagged for not having a Family Care Plan. The reg said my wife's anability to take care of herself led to this. Yes, I had said previously that she was waiting to be put on EFMP, she is now. Whom determines the "inability portion?" Is it the chain of command or legally speaking a specific disability. She is not legally disabled.

Also, I had worked around the regulation. My COC had not really cared much about my workaround. I had not initiated the FCP so as to send my wife home temporarily as to avoid needing one.

When the COC did the 268, TDS denied it because I sent my wife home, and there was no evidence of my wife's inability through my Counselings.

So about two months later, the initiation of my flag removal happened. 4 months later down the road, still having trouble removing my flag even after submitting three new 268 with a DA 200.

Any reasons why it's not off when we've done everything we could to lift it.

You can't remove a flag, only your commander can initiate or remove a flag. TDS didn't deny your flag because TDS has no authority to flag, unflag, or stop you from being flagged. Otherwise, you wouldn't be flagged.

If you feel you are erroneously flagged, then you should talk to IG. They can also answer your questions about who determines what requires a family care plan. This is exactly what their job is for.

SPC Dasan Toney you said "I have" submitted three. You don't submit 268's. The commander signs the flag removal, S1 removes the flag simple as that. No chain of command, just the company commander. It takes 30 seconds for S1 to go in emilpo and remove the flag. If S1 isn't processing your Commanders flags, your Commander just needs to walk in and tell them to do it on the spot. There's no hidden reason. They just sign in, type your name in and click remove flag.

This is a "whine post.". Absolutely nothing anyone says here changes anything that has happened, needs to happen, or will happen. Additionally, you already know the answer to the question you are theoretically asking.

Quit whining and talk to your CoC.

Has the CO taken the DA 200s to the BN XO to ask why the S1 is so jacked up?

Has the CO highlighted it during Command and Staff directly to the BC?

These are all things that are directly on your CoC. They are also things which they already know. There is quite literally nothing you can do at this point aside from talking to your CoC and making sure it does not fall of their radar. And nothing anyone here says is going to change that.

So YOU submitted three Flag Actions on yourself?
Because that's basically what you said. Are you in a Command position, which I find difficult to believe since your listed rank on RP is SPC/E-4?
A DA 4187 Form is used by US Army soldiers to request personnel action, which is what you need to file AND regardless of your desires it is a request, not a Command. Your CO is the one who decides to give and is the only one who can remove the flag. A Flag does not automatically change just because you change units or a new commander takes command.
