I’ve received orders for Korea and running into a situation that could cost me financial hardship. I’m currently a single soldier who is receiving full BAH at the w/ dependents rate (2 children) and paying child support. Both child support payments I make have BAH and BAS factored into them (yes they can do that).

Ive been to ACS and set up a financial budget for my future estimated earnings with BAH-DIFF included and I was shown to be in the red in every scenario we laid out if I were to lose it a housing allowance.

So since I have two dependents, will I still receive BAH based off my previous duty station? Or will I end up losing everything?

Unless you are the custodial parent you will lose your BAH w/dependents rate. If you and the other parent can come to an agreement to allow you to be the legal parent for the year you are in Korea, you would receive BAH for their location. Otherwise, you will need to file for a temporary reduction in your child support based on your expected loss of income.

SGT(P) (Join to see) what I did in the same situation was recreate a version of the one already filed with the court house, edit it to our needs and then have both parties notarize it before submitting it to finance. Worked just fine in my case

Ok, so I’m understanding you kept what was through the court originally but remade one in which both parties agreed upon then had it noterized, omitting the need to have the courts involved again, and that worked for you. Did I get that right? SFC (Join to see)

SGT(P) (Join to see) pretty much, yes. You should still file the agreement with the court, but yes.

This may help. The document includes links to the relevant regulations.
