On the one hand, I think non-competes are out of control and often ridiculous.

When I was applying for a job as a pizza delivery driver on post, they wanted me to sign a non-compete that included ANY private civilian job on post (AAFES, Commissary, etc., but not government jobs), as well as all food industry jobs (fast food, fine dining, and everything in between), AND delivery jobs (not just Door dash or UberEats, but also Flower delivery, Amazon, FedEx, UPS, and even USPS) within 50 miles of post. For pizza delivery. It was ridiculous, I told them it was ridiculous and they didn't care. So I walked.

So, yes, these non-competes are out of control, BUT....

This is not the role of our federal government - or at least it shouldn't be.

This is between labor and employers - if you don't want to sign one, don't. Walk. If enough people walk, the employers will wise up. But employees have given up their power, refuse to take a stand, and then want the government to protect them from themselves.

2019, I hired a guy that had come from a company that is notorious for their non compete clause.
They company he left dealt with less than load trucking and delivery. I hired the guy to sell car parts. Neither has any thing to do with the other.
Three month in, I get a cease and desist letter from the guys former employer. The letter basically stated that I had may have unknowingly hired someone with this clause and if I continue to employ that person, I would face civil action. The guy I hired also got a letter stating that he was in violation of the non compete and if he didn't quit, he would face legal action.
I was pissed off over the audacity of it, but took the letter to my lawyer.
In the end, I had to let the guy go,in spite of my reluctance to. My attorney explained that I could beat this, but it would cost me more than I had resources for, and no chance to recoup my losses over principal.

Unfortunately the Progressive Democrats, RINOS, and Communists in our Country want Total Control of our lives. That is their mission. :(

keeping people from being able to freely work anywhere they want is clearly a very communist thing.

SGT Chris Padgett - Sadley it seems you miss the point of the post. People are free “to accept” employment with a noncompete agreement… or “not to accept”. It is there choice, and once they make it they need to live by their agreement. I don’t like these agreements myself, but I can see situations when they are needed to protect the employer from being taken advantage of. There are good and bad people on both sides the the street.

In the case you cite the employer was definitely wrong and the agreement was being used in the wrong way. You would have won if you pursued but you “chose not to”. I don’t hold that against you. Everyone needs to follow their own path.

As for the down vote, I will keep my good humor and chalk it up to you possibly being new on Rally Point and not understanding what down votes are for, or maybe you can’t understand why an agreement like this may be needed. In any case I’m not going to start a war over what I perceive as a trivial thing.
