NTSB found the Officer of the Deck hadn't had a lot of sleep prior to the collision. The skipper is responsible for everything his ship and crew does or does not do. We all know this when we take command.

The commanding officer has the ultimate responsibility for the safe navigation and safety of his vessel and crew. The word ultimate is the operative.
