Criminal defamation is not protected by the First Amendment. Granted the level of proof required to show criminal defamation is high, as it should be, but a person who is guilty of criminal defamation cannot hide behind the First Amendment.

As as matter of fact, several states (17, I believe) also have "cyber-bullying" (a form of criminal defamation) in the state statutes as crimes.

Regardless, the conversion was about reporters purposely spinning the facts or outright lying.
