1LT (Join to see) - Except that OJ was charged, tried, and found not guilty by a jury of his peers. HRC just gets a pass without even so much as going before a grand jury, despite actual evidence of classified information being compromised by the actions of her and her staffers. It's a good point, but there are some differences in how those two situations play(ed) out.

I think administrative punishment is still necessary. It would be funny if she and her staff gets their clearance revoked. President with no clearance...that would be something.

MAJ Carl Ballinger - Even givens are codified in a law, regulation, or executive order. As you know, the IC, under the DNI governs access to SCI material stemming from an executive order 13526...even the POTUS must follow it unless they explicitly rescind it. If it codified by law, then even the president must follow it...unless you are saying the president is above the law. As you can see it not simply a "given"

MAJ Carl Ballinger - last time I checked 18 USC 798 applied to everyone. No, he cannot "declassify" anything without the ORCON and legal review. Also, if any item is declassified then no law is broken (except in FOIA related cases). Once again, in order to have a productive discussion, it would be helpful to provide a law, regulation, or order for the benefit of the debate/discussion. Providing opinion as fact is not productive.

MAJ Carl Ballinger - Yes, you are correct on the declassification policy but he cannot simply disclose stuff without declassifying it. Of course, just because he says "poof declassified" it doesn't mean it didn't cause "grave damage". So based on your opinion, do you think the president can simply declassify all of our nuclear missile data or disclose HUMINT sources with zero legal or administrative consequences? Remember, he can say "poof declassified" and it will no longer be classified.
