I don't know if he deserves an upgrade but I think he certainly deserves a review. Even after reading both parts of the article it doesn't say much that would explain him getting an OTH instead of at least a General.

PO2 Robert Aitchison In part 2 article it says "While men from Battle Company lost lives and limbs, uncovered mass graves and broke the back of the Islamic State of Iraq in Diyala province, there sat Mintz behind a desk at what is now Joint Base Lewis-McChord — except for the month he spent in a Navy brig in Bremerton, Wash., following his AWOL and marijuana charges. He missed the tour."
AWOL, Drugs, failure to deploy with your unit due to misconduct.....yes I can see an OTH discharge no issue at all.
