When not in uniform I do not wear my helmet- it is my choice and one I may regret one day, but that is how I chose to ride. If it ever comes to the point Iowa made you wear them- I would. Nebraska has a helmet law- and we re-route rides for that very reason. South Dakota does not and they get a lot of business in our corner of the world because of that.

Actually sir I think if you review the refs and policy's from DOD and your service you will find you are required to wear all your Ppe anytime you are on your bike, uniform or not

SGM Erik Marquez - therein lies the beauty of being a dual status technician. I only fall under the UCMJ when I am on orders or IDT.

So I didn't realize till after I posted your National Guard guy and brings up in his plan question I'll have to look up the Reagan's policies for see what it says when I reserve or National Guard soldier is not on orders either for drill 80 or Dept.

SGM Erik Marquez - not really a policy. They can only require things when you are in a status however- that is not to say you could tell your CC to bite you and not expect some repercussion. Legally though- they don't have much over you when you are not in status. In status...whole different ball game.

A few years ago a few do-gooders in the TX State Legislature managed to pass a motorcycle helmet bill and got it signed into law. It wasn't too long befoe the cycle riders around the state woke up and began to catch on there was a law. They immediately banded together and descended on the state capitol here in Austin in all their finest motorcycle regalia. Circling the capital making all kinds of noise, they parked, went inside and began to visit Legislator's in their offices making their feelings known. Shortly thereafter the legislature reversed itself and repealed the helmet law.

I always wear my helmet mostly because Georgia requires it. Whenever I go to Bike week in Daytona though I usually do not wear when I am there unless I get on the highway then I will wear it. I do believe it is a freedom of choice for the person to decide to wear it or not. They know the risk if they do not wear one.
