The reckless disregard will be easy enough to prove here. And I do not think that juries are as willing now to give garbage media folks as much slack. She would have been ok if she had stopped after the cop was slapped down court.

1stSgt Nelson Kerr - It's a question of law, not fact. The jury won't answer the relevant questions, the judge will. Second, the standard for the media is not mere reckless disregard, especially since the sections were allegedly out of the court opinion. No, you'll have to show actual malice towards McKesson, and I don't think he can meet that standard.

I was amazed that Fox News considered a journalist or commentator making accusations on TV without facts to substantiate the allegations to be considered protected free speech. That would mean each time Bill Maher joked about Trump being related to an orangutan should be considered protected free speech not subject to defamation lawsuit. Just sayin'

1stSgt Nelson Kerr - Simply focusing on the defense of Fox News that their journalists and commentators can make blind allegations about anyone is considered protected free speech regardless implying criminal activity or simple false allegation. They've spent the last 8 years fine tuning that technique.
