The other unwritten part to the unwritten "Biden Rule" is that the opposition party generally has to control the Senate to enforce it. I'll save anyone who needs it both the effort and suspense of looking it up: the Democrats do not presently control the Senate.

True that! Further, I don't think Schumer can count on keeping all his lads and lasses in line. The political dynamic hasn't changed much since Senators Joe Manchin (D-WV), Heidi Heitkamp (D-ND), and Joe Donnelly (D-IN) voted for Neil Gorsuch during his Senate confirmation. As long as Trump puts up a well-regarded nominee, it is not unreasonable to think that they might cross the aisle again. Manchin, in particular, has been doing his damnedest lately to look and sound like a Republican or, more accurately, a Trumpist! There may be others that face voters in November that decide obstructionism isn't the path to election day victory.

LTC (Join to see) - Just to expand on my last sentence above, 10 Democrat senators are defending seats in states that Trump won in 2016, and for some, that will undoubtedly soften their lockstep vote on Trump's nominee.

You recall the Biden rule, in 1992, was the Senate would not confirm a Supreme Court nominee in the middle of a presidential election year, which was my view last year. Senator Schumer said in the second Bush administration that they would not confirm a Supreme Court nominee in the last 18 months of President Bush 43’s tenure. Apparently there’s yet a new standard now, which is to not confirm a Supreme Court nominee at all. I think that’s something the American people simply will not tolerate and we’ll be looking forward to receiving a Supreme Court nomination and moving forward on it. “
