Capt Gregory Prickett: Interesting article. But it doesn't surprise me in the least bit. Falsifying documents, planting evidence, etc. is way too common than most people know.
My question is whether the perjury committed to obtain the search warrant is continuous so that felony murder charges would be upheld on appeal. Looks like Texas requires an ongoing commission of a crime in order to charge felony murder. Does the perjury of the warrant remain in effect until the warrant is returned?

Patricia Overmeyer - Burglary in Texas is entering a property with intent to commit a felony, theft, or an assault. Pointing firearms at people is assaultive conduct.

Capt Gregory Prickett - Good points. Thanks for the clarification of Texas law. I don't practice in that state so I'm not that familiar with their criminal laws as far as case law delineations. It would be interesting if they actually did charge the officer with felony murder as it does look like it would fit the statutes. Please keep us posted on the progress in this case!

Gregory, you used to be a cop yourself and are now a lawyer. You should know that a lot of modern day cops are crooked as a barrel of snakes.

What I don't understand is that his supervisors should have seen that was something "off" with Goines as he was coming up, yet they continued to put him on high profile assignments. With your experience Capt Gregory Prickett, how do you feel about "no knock" warrants. I wasn't really happy the Chief absolutely 99.9% sure he is going to discontinue the use after this. Wouldn't it be better to make sure there is a better review process prior to issuing, rather than taking a tool away from police? I honestly don't know if no-knock is that important, since I have no LE experience (other than a few speeding tickets!).
BTW - you have more facts in your article, than the news reporters down here!
