I am absolutely in agreement with you. Trump wanted him executed. I can't say I disagree.

Need to overturn it to desertion and dereliction of duty, with a dishonorable discharge and prison time.

I am in awe of how you can read the law, and unfailingly get every single bit of it wrong.

I didn't write the article. By the way, if law were all black and white as you infer, why would we ever need to go to court? I'll tell you why, EGO. Instead of the TRUTH, American justice is more about winning and losing and then meeting at the pub later to laugh about the poor dumb bastards who "lost," while both lawyers clean up and then fatten their bank accounts. No offense intended. In this country, without lawyers, we would probably implode.

MAJ Montgomery Granger - no, I know that you didn't write the article. I'm talking about your 2 sentence, 28 word statement at the top of this post. Second, the military judge in the case, COL Nance, found that the defense successfully showed that there had been unlawful command influence by Trump after he became president. Nance then found that the government carried its burden, which allowed him to proceed with the sentencing of Bergdahl. Third, Bergdahl at no time faced execution, as that is only a punishment that is authorized "during time of war" and we are not at war. He faced a potential life sentence for misbehavior before the enemy, but only faced 5 years for desertion.

My comment as to your getting all of it wrong had nothing to do with winning or losing. It had to do with the fact that you're not cognisant of the legal issues involved.
