Theoretically, and on paper, yes. Space Corps is military in space. Spectres are having your own ship, armory, and legal freedom to do pretty much whatever you want so long as it's for the greater good.
Once again, this is all in theory, and discussing the moral and ethical dilemmas requires more booze and understanding of war crimes than most of us have.

While it is awesome, one needs lottle imagination to see the failings of a system where you have an agent, and their crew, who have little to no oversight or accountability for their actions and the consequences thereof.
Within the game of Mass Effect itself this is covered within the first couple hours when a Spectre you spend the entirety of the game is discussed as ruthless and having set a factory on fire and killed hundreds of thousands of people, all of whom were the factory workers and their families, to get to a single criminal and save himself some time. This is before mentioning the potential war crimes you can commit for the sake of gameplay choices, most of which are praised by the Council.
