CW4 Guy Butler - actually Berman was not confirmed by the Senate, primarily because he wasn't nominated by Trump. Instead, German was appointed to the position by the judges of the Southern District of New York under a provision in the US Code that allows such action on a vacancy. Berman's appointment, under 28 U.S. Code § 546, lasts until a Presidential nominee has been confirmed by the Senate. Neither Trump nor Barr may fire Berman.

CW4 Guy Butler - Yeah, I saw that.
It is still the right answer if they don't want him there anymore.
The more salient question is why does the Justice Dept want him gone, and that might not have a very good answer.
