Constitutionality seems to be the way the new team plans to go. They'll still have to endure all the video. A test of the Senators' constituents threshold of pain. We've already seen how little that matters.

So, impeached as a President, tried as a President/private citizen. I am not a lawyer so I don't try to twist the meanings in plain text. The Chief Justice has already said he won't be there. The Impeachment was for a President. The trial would be too.

You were drunk when you got that ticket. We are going to charge you as being drunk. But - your trial will not cover you being drunk.

Yea - it's a hot mess.

That's not a bad comparison. Think of it like this. A police intentionally falsely arrest you and plants drugs on you. There is inconvertible evidence that he did so, and the DA charges him with Official Oppression by a Public Servant, the punishment for which is removal from the office and jail time. The officer gets fired, so that he is no longer a public servant, and at the time of trial argues that he can not be tried because he's no longer a police officer. So does he get to walk? He's not a cop and can't be removed from office...

Yes. A conundrum for sure. But, as you have pointed out, this is a political trial, not a criminal trial.

Nuances abound and both side seem to be straining and bending things to no end. In the end, this sets a precedence for impeaching any POTUS for any ol reason. Just get the votes, push it through in 12 hours. Done deal. No right to representation. No facing your accusers. Hell, no real evidence out side of opinion. And don't even try to give me that "he incited violence" bull crap. Not a single outlet or politician can point to a clear phrase of "attack Congress". But, that is beside the point. We have a circus to watch and my opinion, your opinion, and anyone else's opinion are not worth a frog fart in a hurricane.

SSgt (Join to see) - He doesn't have a right to representation, nor to face his accusers. Never did. Due process in non-criminal matters consist of: 1) notice; and 2) an opportunity to be heard. The opportunity to be heard can be limited to presenting the deciding body with a written document stating his position. That's all that the Constitution requires in non-criminal cases.

He's getting plenty of due process.
