You can't just limit it to sexual assault though. Commanders should not be making prosecutorial decisions in any case.

I've heard stories of people committing crimes or doing things that should get them kicked out or lose a clearance but commanders recommend retention because they like the SM. How is that maintaining good order and discipline???

Are they afraid the "Good Ole Boy" club won't be able to protect their own any more? Granted, Commanders should never be cut out of the loop but there is more than enough documented cases of why an independent agency should be involved with the process.
