CPT Jack Durish - Try what "crap"? Pointing out that opposing counsel is unprepared and wrong on both the facts and the law? Sure, I do it all the time. The best one was when, for my opening statement, I told the judge that if it wasn't for the fact that he would find me in contempt, I would use the opening argument of attorney Vincent Gambino from the movie "My Cousin Vinnie."

The judge had to cover his snickering with his hand, but I don't think that opposing counsel liked it too much.

Dred Scott v Sandford: Black people are not and could not be citizens
Plessy v Ferguson: Racial segregation was lawful so long as public facilities were "separate but equal"
Roe v Wade: The unborn have no rights AND the Constitution includes a right to privacy
All three decisions were forced by popular demand despite the fact that popular demand has no place in a constitutional republic. Popular demand is a hallmark of democracy only (mob rule).
With the overturning of Roe v Wade, women still have rights, just as many as men. Sadly, we no longer teach our citizens that with rights come responsibilities. When people, men and women choose to have sex, they have a responsibility to the issue of that decision. They cannot avoid that responsibility under cover of some illusory right to privacy fabricated out of whole cloth.

SrA John Monette - Dred Scott v Sandford (Blacks cannot be citizens) and Plessy v Fergusson (separate but equal). Both were justly overturned

CPT Jack Durish - The Dred Scott decision wasn't wholly overturned, it was superseded by the 13th, 14th, and 15th Amendments as to slavery and citizenship issues, and was only partially overturned in 1976 with the Kleppe v. New Mexico decision. Unless, of course, you have legal research that shows otherwise that you are willing to share.
