The US Civilian Legal system considers him innocent until convicted. However, he cannot be proven innocent or guilty until he returns to the US to face the allegations. If he were truly and provably innocent I would expect him to embrace the opportunity to be exonerated and waive extradition.
If he is convicted, he needs to receive the maximum sentence possible. He's a Marine for goodness sake.
